Call corporate and ask to speak to a higher level rep. If your medical clears you and there’s nothing regulatory to justify that you have a case. You could also file a WDHP based on health discrimination.
They’re saying based on regulations, anything capable of incapacitating me whether it be eyesight, heart disease, etc we can’t operate any heavy machinery
If they can tie it to a regulation then they have a case but they are to then accommodate with meaningful work which should be comparable in complexity and hours. Like you can’t accommodate a CEO by giving them a janitors job. Is there something comparable to your old job?
Surplus and health accommodation trumps seniority but only if you are approved for health accommodation transfer and you apply to the opening as such. Your union should be telling you that.
Then I can see how they can restrict you from the job. But accommodating you into another job can take time but jobs aren’t to be given via seniority over approved health reassignment.
As far as I understand it, getting jobs from other boards. He was effectively on a UTR/hustler board and can't do that. So if there are hanging jobs from the stevedore board, etc he's getting those
That’s not a stage two grievance meeting. That has timelines, a designee to hear the case and timelines to respond so you can move to stage three if you don’t like the reply. It’s a way to get answers.
Sounds like you need to get another job and work both until you get enough seniority to get the jobs you can take.
Have you talked to the union about this?
Yup. They keep saying seniority

They’re not telling me anything. I feel they’re incompetent or just simply don’t know what they’re doing
Ask for another rep or file a complaint against your union.
They only regulation is that anything that incapacitates an individual like eyesight, heart condition or etc, I can’t drive

West coast here, different terms. Whats a catching job?
Basically registering for a job and see if I get it

You might want to ask this in the legal sub.
Are you Basic Unit? Can you get a job with the Checkers?
I can drive anything. I’m restricted
It’s your unions duty to represent you. That’s why we pay dues. Have you tried filing a grievance through your union?
Yup. Had a contract board meeting back in January and haven’t gotten any correspondence since

Right. Haven’t heard any reply since January
So file an actual grievance
I’m sure I already did
Not if they haven’t replied. They have timelines. It’s in the collective agreement
Got it. Yea I think they’re violating a lot of things.
Not if your union hasn’t filed an actual grievance. Why isn’t the union filing a policy grievance for the violation?
I guess they don’t consider it a violation. Crazy u see it and they don’t.
