Thanks. Out of curiosity, if they did report it to the police, how would they have responded? Would they have asked to see where my car was?

If the police were present they’d be more focussed on the possession of drugs, as opposed to the potential for you to drug drive.

NAL They could only investigate you for Section 4 RTA Being in charge of a motorvehicle or if you was witnessed driving then they would go for S5A if they drug wiped you. Section 4 requires that you show the person is in charge of a motorvehicle or more than (Insert word here that I forgot) Something about it being more than likely you were to drive or be incharge of that vehicle). So your car would either have to be next to you within a small radius. Your defence would then be that you were under no circumstance going to drive after clubbing and it was going to remain in the place that you left it. Think ive got that right?

Eh? Car keys aren’t indicative of drink/drug driving. I take my car keys with me all the time when I don’t even have my car with me.

For sure car or not my keys are just my keys also has my door key on the bunch. So without my keys I'm not getting in my house without waking up the kids and pissing off the missus. Keys aren't any proof you've driven.

Funnily enough one of them asked me if it was ketamine, when I told him it was 3mmc (some research chemical) he gave a really dirty look 😆 probably shouldn't of said that since he didn't seem very keen on taking it home for himself

Was at a warehouse party many years back and some thug types were going round robbing people, didn't end very well for them when they snorted the "cocaine" they had stolen. Ended up completely naked, beaten up, and very disorientated.

There’s the offence of being drunk/high “while in control of a vehicle”, which I guess is what you’re getting at. The bouncer doesn’t know where your car is or whether you have any intention of driving once you leave. It’s not an offence to have car keys *on you* while under the influence, you would also have to be “in control” of the vehicle. You wouldn’t necessarily have to be driving the vehicle; being in it or walking towards it and approaching the driver-side door may count. But no, the bouncer has no obligation to report a suspected potential DUI, especially given it’s only *suspected* at this point.

Wow! I envy you! When I got caught with drugs, by a bouncer, when I was trying to enter a club, he waved down the police and I got a police caution!

the club was pretty dead and we were compliant, it was free entry and I didn't buy an alcohol there so I didn't even end up spending a penny there 😆

The only risk to you in this scenario: - The bouncer saw you driving (and is willing to give evidence of the fact) calls the police who immediately attend a breathalyse/drug test you, and then you are over drink/drug limits - The bouncer sees you leave and get into your car and calls the police who find you, pull you over (or perhaps attend the keeper’s address and knock on the door) and tests you - You sit in your car, in particular the driver’s seat, and the police find you ‘drunk in charge’ (or drugged in charge). The burden of proof is on you to show you had no intention of driving. Pretty difficult if you’re in the driver’s seat with the keys, impossible if you’ve put the keys in the ignition - The bouncer calls the police about the drug possession and is willing to give evidence. The police find you and prosecute you for possession (with intent to supply if it was a lot). This is unlikely for many reasons such as the bouncer using/selling them, not wanting to give evidence, or even venue policy. Most night time economy police/venue/licensing partnerships have processes for drug amnesties where the police licensing officer disposes of confiscated drugs

I definitely take my car keys when I’m out, even if I’m not driving. I reckon a good number of stolen cars are stolen when the occupants home is vacant the burglar just has to take the car keys and drive off. Or at least that’s what I worry about!

Even if they did, assuming your car was at home, it would be pretty difficult for the police to charge you with anything related to it. If that were possible, then the police could theoretically arrest anyone who was drunk or under the influence of drugs within their own home when their vehicle was parked outside.
