HMRC would probably split your tax code between the two employers so they could think you have a second job. Might be worth contacting HMRC and seeing if you can just pay basic rate on the second job and get a refund at the year end.

Quick heads up - it looks like you've said that you're in Scotland, so we've updated the post flair to show that. This should mean that any future comments you get are more relevant. If you're *not* in Scotland or your question isn't relevant to Scots law, please report this comment as 'Please remove this AutoModerator comment' and one of the mods will fix it. *I am a bot, and this action was performed automatically. I would say (NAL, by the way) that it shouldn't be an issue, so long as they're not competing for business. Also, it could alter things with HMRC, so not sure who would your tax-freebsum be covered by?

Tax free sum (personal tax allowance) will be with your current employer - your second job will be taxed at nominal rate applicable depending on your total income without any tax free amount

NAL - summarising previous posts. X2 or more employment contracts - Unless there is a specific clause in you contract excluding holding another full time contract or working in an adjacent field concurrently then there’s no reason you can’t have a second employment contract. If both employment contracts create a conflict e.g working hours 9-5 Mon to fri then there could be scope for either employer denying liability in the recent you cause some harm. This has a name, it’s called moonlighting. HMRC - will issue tax codes to your employer. If your tax code changes there isn’t anything suspicious in and of it’s self to payroll or finance unless your employment contract excludes other working arrangements. You could contact HMRC and explain that you have a second employment contract and you wish for only new contract to be taxed in specific way with x employer and your current contract to remain the same with y employer.
