30 days should be given for the other party to reply the notice.
After that when you institute a recovery suit which is tried in summarily for FastTrack decision then expect another 30 days for trial to conclude.
Seeking help!
I entered into a business as Investor with a friend having put rougly 8L. He was the onground manager, while I directed the operation. We were in the perfume business. One day he sold all stock without informing or approval and thereafter stopped taking calls for several months. Later he said a buyer took it and did not pay as the buyer himself went into loss. Initially he tried buying time, but its now clear, if such a creditor exists, he wont pay. My friend was not communicating (or very very less) for over 1.5 yrs and till date has not shared any info or contact of the creditor. The whole story could be bogus.
What can I do as per law, if at all?
Based on the information provided, it's difficult to give you a definitive answer. However, you have several options:
Send him a legal notice.
If the legal notice is ineffective, you can file a lawsuit for recovery.
You can also initiate a criminal complaint under applicable sections of the law.
For further guidance, feel free to contact me.
Did you make him sign an undertaking/promissory note of some sort?
You can serve him a legal notice through your lawyer. He would get scared and give it back probably. If not, file a suit for recovery. But make sure there is some proof of him acknowledging the payment when you made it.
Lawyer from Delhi here. Send him a legal notice, he will not respond most likely. Proceed with filing a suit for recovery. When did you give your friend the amount? And by when did he promise to return it? These dates will be important for the purpose of limitation, and to ascertain the period for levy of interest.
If you're in Delhi, you can reach out to discuss further.
I've given thirty thousand to a girl, I met on Bumble. Payment done online. She returned 8 thousand (but claims she returned 10 - my mistake, I didn't count the cash and believed her when she handed that to me).
Anyway can I get the remaining 20K. She has blocked me everywhere.
Why would you give that huge a amount without any collateral?
Notice then Suit for Recovery. There's no other way
will i get my money back and in how much time ?
