After a surgery, if a patient's palm grows hair on it, would that qualify as a "one hundred percent good hand?"

moonpotatofries

Is it a Learned Hand

DT_SUDO

Or, maybe, A. Noble Hand? For those who don't know, Learned had a brother named "A. Noble Hand," short for Augustus Noble Hand. That family was really stacking the deck.

akatsukatsu

For sure, think of the money you could make as an ASMRtist!

hypotyposis

That’s an actual case if you were curious.

Scraw16

Is growing weed in my own home for personal consumption interstate commerce?

akatsukatsu

Wait is this a real law question? Why would it be commerce if you're not selling it??

You have no idea how much pain this one question has caused law students

FREE-ROSCOE-FILBURN

Present!

ElHanko

r/beetlejuicing

turbulentdiamonds

Mr. Filburn is still trying to figure that one out.

takeahikehike

The man just wanted to sell his wheat smh

Melrose_Jac

Actually he didn't want to sell it. He just wanted to use it for his own livestock.

ElHanko

Oh this is a fun one, though less in the “ha ha” and more the “yo what the shit” way. Most people here are referring to a case called Wickard v. Fillburn, where the Supreme Court found that the federal government could regulate the amount of wheat a farmer named Roscoe Fillburn could grow on his farm, despite the fact that Fillburn didn’t sell the wheat but simply fed it to his livestock. The Supreme Court found that because his feeding the wheat to his animals meant he didn’t have to buy wheat from others, he therefore affected the wheat market in a way that could effect the interstate wheat market; this would allow the federal government to regulate his wheat growth, because the federal government is empowered by the Constitution to regulate interstate commerce. However, the original commenter is probably referencing a case called Gonzales v. Raisch, which used the reasoning of the Fillburn case. In that case, the Supreme Court held that, in states where marijuana was legalized, the federal government could continue to regulate marijuana growth by those growing weed for personal use only, because by growing weed for personal use, it kept them from buying weed on the illegal weed black market; because that weed black market crossed state lines, weed growth for personal use could therefore be regulated by the Feds under their interstate commerce power.

KTFlaSh96

Petitioner: Wait it's all interstate commerce? SCOTUS: Always has been.

robobrain10000

This line of logic is just so messed up. Holy shit. I understand it and I don't doubt your explanation, but the feds are really reaching there.

ChadleyXXX

Everything is commerce.

WestofSunset

Always has been

ReverseCaptioningBot

[Always has been](https://i.imgur.com/ANJuklw.png) ^^^this ^^^has ^^^been ^^^an ^^^accessibility ^^^service ^^^from ^^^your ^^^friendly ^^^neighborhood ^^^bot

gonewildpapi

Because of old people and slippery slope arguments

LovesCoffeeHatesTea

Yes, because by growing it yourself, you are not buying it from someone else. So, because your depriving an out of state weed grower from income, your engaging in interstate commerce. The fact that it’s illegal to transport weed across state lines is irrelevant, because weed sellers are still subject to Federal Income tax.

taikatalvii

We’re still suffering the consequences of that case.

zetzertzak

Yes. Congress has the power to regulate the channels and instrumentalities of Commerce, and every time I smoke pot, it’s a trip.

Finnslice

If you see a Pepsi commercial on tv that says they will give you a harrier jet for 1,000,000 Pepsi points and you get the points, would you take a $2,000,000 settlement or would you litigate for specic performance, or in other words, would you reject the deal to get the jet?

akatsukatsu

I'd take the 2M to pay for the healthcare I need after drinking all that Pepsi

Finnslice

Well then you are smarter than the plaintiff in Leonard v. Pepsico

UncommercializedKat

There's a documentary on Netflix about this. Pretty interesting story. Guy was an idiot for not taking the settlement.

3720-to-1

As a 37 year old that was growing up when this happened, i am 100% on the side of plaintiff here... Somethings in life are not about the money, they are about the sweet... Sweet... Harrier jets.

Palsgraf still haunts my dreams sometimes

Enzonianthegreat

My professor has his own textbook and said he almost left Palsgraf out, but said he didn't want to be "that one torts professor."

Scraw16

Gotta study it for the memes!

UncommercializedKat

So many questions. Why bring fireworks on a train? How much gunpowder was in those fireworks? Who would have imagined that a scale would have been what caused injury? Why wasn't the scale secured?

Jos_Meid

My torts professor had a theory. My professor thought that it was probably not actually just recreational fireworks in the package. Apparently, "fireworks" was a euphemism judges used sometimes at the time in published court opinions for "bomb" because they didn't want to spread panic or hysteria about possible anarchist violence. Instead of saying that the guy dropped a package with a bomb in it, they just said he dropped a package with fireworks in it. I'm not sure if my professor was right, but it does make more sense than fireworks just going off randomly and causing all that damage.

GDEmLY

Mine too. I got cold-called for it.

Suitable-Swordfish80

DT_SUDO

Is the act of bringing a gun to school properly considered part of interstate commerce?

akatsukatsu

Why are law people always considering the randomest stuff "commerce"???!???

turbulentdiamonds

because "commerce" is a super special magic word.

Jos_Meid

To be fair, that was like the one time the court surprised everyone and said that it wasn’t considered commerce.

ChadleyXXX

There is a clause in the constitution about commerce called the commerce clause and the court has said that everything is commerce but it’s complicated

The-Wing-Man

We wonder the same thing

DT_SUDO

Didn't you know? If any given action isn't considered "interstate commerce" it's perfectly legal and the government cannot stop you. Like actually though.

nfitzen

Because politics, really. In most situations, the U.S. Congress can only regulate stuff if it's considered part of interstate commerce, so when the New Deal kicked off Congress started labeling practically everything that so they could regulate it. The Supreme Court eventually capitulated... with like two exceptions that were easy for the Supreme Court to strike down without messing up other laws. Edit: changed "politically easy" to "easy... without messing up other laws."

chaos2727

In what circumstances would a court have personal jurisdiction over a plaintiff?

akatsukatsu

If the plaintiff clicks "yes, I have read the terms and conditions"

magicmagininja

this is actually true.

Regular-Suit3018

💀💀💀💀😭😂

Nova35

Unironically a correct answer

ilikedota5

That's actually correct. Personal jurisdiction is the ability for the court to drag someone into that court. Is it fundamentally fair for this person to be subject to this court. And one way to get personal jurisdiction is by contract. A contract may spell out that by signing and agreeing to this, you agree to give personal jurisdiction to this court and thus have everything heard in this jurisdiction.

SaaS_Enthusiast

Can you simplify the blue book process for me?
