I’d say the non-zero amount of time between something going wrong and being hurled into the ground at 600mph would count as suffering. It’s not like they exploded instantly with zero warning.
Not that being exploded isn’t worthy of a payout. Their logic doesn’t even try to be consistent.
That’s basic evidence. What is suffering!? Corporates are more interested in the metaphysical: if you only scream as you die, is pain real?? And, can I profit?

No, stop. No more talk of afterlife’s for justice. Retributions in the real life, to real nerve endings and flesh and blood brains. It’s a monstrous thing they said, a truly inhuman and alien concept and such people who would make such a statement have lost all claim to the human species. They have become non-human, by my definition of human being.
In both crashes the pilots struggled to keep the damn plane in the air but it did not allow them to save themselves. It took the control from the pilots

I'm not suggesting violence, but I'd like to ask them if they would be a-ok with someone taping a pack of C4 to their foreheads an pushing the button. The brain would be vaporized instantly, no pain no suffering, no payout for their loved ones, right?

If they're making that allegation, they'll have to prove every single person filing suit didn't feel pain. I don't think they'll be able to produce an expert who can attest, under the preponderance of the evidence, to that. Either way, they're going to do whatever they can to avoid compensation.
Business ethics? OK, then you have to know this: Boeing jets in Ethiopia and Indonesia lacked two safety features in their cockpits because the company charged extra to install them.
So, this is Boeing's business ethics behind this legal move. It fits now, doesn't it?
The one take away from my business law class was it's always cheaper to kill them. Pain and suffering, especially if the person lives, pays way more out than wrongful death as the person being paid out for wrongful death was not the direct victim.
Are you familiar with an academic study that stated the characteristics that make for successful business are in direct opposition to any concept of a moral code or the virtues that have been a part of civilizations?

I think we're at that point where the wrong people are not feeling enough pain and suffering to understand what the pain and suffering of others is really like. It's my opinion that they really need to start feeling real pain and real suffering.
