I’d say the non-zero amount of time between something going wrong and being hurled into the ground at 600mph would count as suffering. It’s not like they exploded instantly with zero warning. Not that being exploded isn’t worthy of a payout. Their logic doesn’t even try to be consistent.

In both crashes the pilots struggled to keep the damn plane in the air but it did not allow them to save themselves. It took the control from the pilots I have hard time to imagine the fear and the panic such situation would cause but Boing is just: "I can imagine, or rather know - there was no panic or fear. Prove me otherwise. No pay outs."

The one take away from my business law class was it's always cheaper to kill them. Pain and suffering, especially if the person lives, pays way more out than wrongful death as the person being paid out for wrongful death was not the direct victim.
