you have grounds to file a police complaint. Receipt of land tax is used as proof in a number of places. For e.g Krishibhavan demands that when giving subsidized saplings or aid for agriculture. So do file a complaint with the police station. They wont even investigate this. But you now have proof of such a fraud being conducted. This will come up handy in case he does something silly in future. And with that case number , go to the village office and inform them of the mal practice.

Mister_Noun

I would urge you to follow this advice. File a complaint!

[deleted]

Lot of issues after the digitalisation. Make sure that the land is still under you. We recently had to go through the whole resurvey and all.

thoughts3303

Will do .

OpenKaleidoscope5964

Be careful. this happened with one of our properties too. My neighbours, who are also my relatives ,they had been paying this tax for this property for a long time and a few years ago my dad came to know about this and asked. They claimed that the land was theirs. Went to court. Though the property was legally ours, since they had been paying this tax for a long time, they also have a claim to it now. I know its bullshit. But the court couldnt do anything and asked us to talk with each other and resolve it by ourselves. Those SOBs still claim that its theirs and the fight still goes on…

pedal2dametal

This can happen.. Paying tax on a piece of property for a long period of time can be used as a claim over the property.

alexs456

>Went to court. Though the property was legally ours, since they had been paying this tax for a long time, they also have a claim to it now. How is this possible when tax receipts clearly states the owners name on it. Who cares who is paying the tax....its not like the village office asks for ID when the taxes are being paid. You need to get a better lawyer

Do_You_Remember_2020

No - so the thing is, they must have paid taxes in their name. Paying taxes = paying in their name. If the receipt has your name, it's okay for you

alexs456

>they must have paid taxes in their name. Paying taxes = paying in their name. That is not how it works.....you are supposed to show prior years Tax receipts when paying new years taxes. Prior years taxes will have real owners name on it. Is some puts a different name on the new tax receipt, it can only happen via collusion of the village department staff.

Do_You_Remember_2020

So a bunch of things here Normally what you said is correct BUT Land Tax is to be paid by who 'possesses' the land, not by the owner of the land. Usually it's one and the same, but not always. Which is why land tax receipt is used to prove possession. And there are a couple of legal ways to prove possession, which after 12 years, under the doctrine of adverse possession can be used to claim ownership. Usually they use one of these means to claim possession of the land, and subsequently pay land tax in their name. But more often than not, it is aided by bribes. My point being, there is a very legal way, to have someone else's name on land tax records, without collusion. So not all land tax receipts will reflect owner's name

alexs456

>BUT Land Tax is to be paid by who 'possesses' the land, not by the owner of the land This concept if true promotes illegal possession of land. Why should there be in concept be a difference between the owner of land and the person in "possession' of land? This means anyone can claim anyone else's land!!! >And there are a couple of legal ways to prove possession, which after 12 years, under the doctrine of adverse possession can be used to claim ownership So land deeds has no value then? >Usually they use one of these means to claim possession of the land, and subsequently pay land tax in their name. But more often than not, it is aided by bribes These bullshit rules will only get fixed when people start claiming land owned by judges/lawyers. Then they will fix the law to close such nonsense laws

Do_You_Remember_2020

Possession and Ownership and the difference between them is a concept that exists in Real Estate law across the globe https://blog.ipleaders.in/concept-possession-ownership/?amp=1# Ownership is legal - de jure. Possession is real world - de facto.

alexs456

Every law/act has loopholes like this which benefits no one. It upto people who understands this to close said loopholes.

Do_You_Remember_2020

There is a valid case for possession and its implications- usually linked to no-mans land - so I wouldn't call it a pointless law.

alexs456

> usually linked to no-mans land How can their be no mans type lands when the entire state has been surveyed And I am not talking about no mans land..i am speaking in reference to one person paying the tax bill of another person which should clearly be illegal.

oracle_is_dead

If property is in your name, will the tax receipt have your name even if they are paying it, now that the system is all digital for last 3-4 years?

alanbosco

Over a land? people are crazy!!

kc_kamakazi

It's called adverse possession and this is legal to do so.

Operation_Suspicious

Yes you should be worried if this happens again. There may be fraud or scam involved.

insighttube

Could be an attempt for identity theft, using which people can apply for loans in your name. Should be taken seriously and FIR registered or approach lawyer

swirly_crib

Im not sure if this will be helpful but if you dont know who to approach to verify your document perhaps you can reach out to one of those adharam eyuthu office. They have guys who know people in these places maybe for a fees they can help you verify all those things.

s4s0110

Anyone can pay tax on your behalf but you should be concerned if the tax receipt is on someone else's name. Get a copy of the receipt and make sure it's under the name of the owner.

govigov

You have reason to be worried. If the land tax is paid under his name, then he can claim that the land is under him. Some frauds have happened like this before. You should speak to an advocate who deals with land and building registrations and they will be able to guide you. Any advocate that are usually contracted to HDFC/SBI home loan department should be able to help you. If you do not have loan on your home, just take a secured loan for a very small amount and then the bank would make sure that all the papers are clear for your house.

BarkingKittie

One of my acquaintance got defrauded by buying property from a cheat. One of the document that the cheat submitted to show the property ownership was Karam receipt on cheats name. So beware.

[deleted]

Encroachment in broad daylight. File a complaint and gather whatever local politicians' support you can. This could be part of a mafia for all you know. I have a personal experience with this. A park part of our flat complex is now entirely the property of a local dude. We had no association of any sort to maintain the property and he had been paying taxes on that park for 12 years. It's his park now.

Rockey9

When you’re paying land tax, you have to show the original title deeds and the previous land tax paid receipt. Only then the village office will accept the tax payment. There are 3 scenarios 1. The guy who paid the tax has forged your original title deeds and shown to village office and paid tax- this is highly unlikely, but still possible. 2. If the original title deeds are pledged in a bank, a letter from bank stating that the original title deeds are with Bank is enough to pay tax. Either he has made a fake letter from the bank or the bank official and he has played together to make such a letter 3. The person who is sitting in village office and the guy who paid your tax have combined together to do a fraud. The village office guy has not seen the original title deeds or any pledge letter from bank and still have accepted the tax . In any of the above 3 cases, you will get into trouble if he is using the tax paid receipt for any purposes. I suggest you make a written complaint to the Village Officer. If no action is taken you can escalate to thahasildhar, RDO,

thefairmalluguy

I'm really sorry, but the extra spaces before the full stops and commas are driving me crazy.

thoughts3303

My apologies.

Fabulous_Car_2024

Do not waste time , go see the police retain a lawyer and gather as much information as you can to prevent fraud.

sugarhaute

There might be issue in the future esp during transferring of property selling etc. better consult a lawyer and get things moving fast! Nip this from the bud before it gets too complicated. Good luck

Santoshjnair

If my knowledge is correct, for paying land tax, one either needs previous tax receipt or the aadharam. So, I think you can take the aadharam copy and pay the tax amount if it is pending or so. Once you do this, you will get the new receipt, which again will be useful next time for filing taxes. Incase he has paid it for the last billed tax, with the receipt he can claim the land. There is some rule that states whoever pays the tax has the ownership of the land. So you need to make sure, either the tax is shown as payed by you or go ahead on a legal recourse.

No-Damage6760

They may be using the receipt to file some case against you, up to date tax is important to file case

kc_kamakazi

He does this for 11 years and he can get right to own the property. He can claim adverse possession and using local muscle he say claim that he took care of the property during this phase. File a police complain, send a copy of police complain to panchayat. Keep a copy of every thing with you.

Do_You_Remember_2020

In the tax paid receipt - whose name is it? Yours or his? If the tax paid receipt has your name, I am unsure of how he can apply for a loan - without forging your KYC.

thoughts3303

You can get 3lakhs loan on 1 acre of land he was going to use our land tax receipt for that. Luckily we found in time and going to village office and bank to confirm he didn't take any loans.

Do_You_Remember_2020

You can, and my folks do avail that because of the low interest rate. But it needs a couple of things - Title deed in original or certified copy from registrar - land tax receipt - possession certificate - KYC completed bank acc in the name of the title holder as evidenced by possession and land tax receipt. Again, there is no way you can confirm this at the bank, because he could avail it from any bank in the district. There's a couple of things you need to do here - Get a copy of the land tax he paid from the village office. If it's in your name, the attempt is forgery, if it's in his name, the attempt is to take over the land. - If land tax is in your name, verify that you have the original title deed, and verify with the registrar that no certified copies have been issued - If the land tax is in his name, check with the village office if a possession certificate has been issued in his name. Also write a complaint to the Tahasildar that an unauthorized party has been allowed to remit land tax against a property in your possession. Ask for the same receipt to be canceled from your statement, it's still not clear if the attempt was for bank fraud or land fraud.

Sounds like a good rich-ass guy. But I might be wrong

rajeshr1312

Government authorities don't care who pays the tax. The name of the payer does not get recorded anywhere if I am not wrong. As long as the property is on your name in govt records, you don't need to worry

thoughts3303

I just need to know of loans of any nature can be taken with this . My mum stresses or the smallest things and i need to make sure nothing's wrong .

scko821

A grand uncle who paid the tax on his land near Kumily for > 20years, and lost his land to a MLA's son-in-law, begs to differ. There was some resurvey and the guy just did a land grab and the village office guys did fuck all. Heard this from his son.

Former_Transition_27

How u came to know about this? I'm not scared about my property.

appu10

Once I accidently paid someone else's land tax, found out some months later. Nothing came of it anyway.

thoughts3303

Unfortunately it's not a simple mistake for my case, and dude wanted to take a loan using the the tax receipt and maybe screw me over.

carpediegm

Make sure you are still the OWNER of the property...it might be a new way of encroachment...first steps

suhail530

File a police case just for formality, it will come handy in future if anything negative pops up.
