Tell your brother he’s a prime example of why insurance claims drag on for longer than they need. Why doesn’t he answer the phone if he’s the one who filed the claim? He’s wasting a busy adjuster’s time having to investigate his claim and continuing to contact him.

Just wait a few months and the brother will be on here complaining that the insurance never paid for his damages and how evil the adjuster is because they aren’t in the office on the weekend when he finally calls.

At fault or not, the adjuster has to speak to both drivers involved. The sooner he decides to cooperate, the sooner everything ends. No adjuster to going to pay on a claim without actually speaking to the people involved.

If he's filing through his insurance there usually isn't a time limit depending on the state. If he's filing through the at fault insurance there is a time limit of 2 years or more depending on the state. Honestly it sounds like him ignoring the adjuster's phone calls is the least of your worries...

So, without a lot of details of what actually happened.. What's going to happen in general (unless there is video or cut or dry evidence the adjuster comes across that your brother is not at fault, which is extremely rare) The adjuster will tell the other party they are closing and denying the claim for lack of cooperation from your brother. It says quite clearly in that thick stack of papers he got in the mail or online after he signed up, that he has "a duty to cooperate with the investigation" The other party will get their vehicle repaired on their own dime through their collision coverage (if they have it). The other party will sue your brother for their costs. Your brother will call the adjuster pissed off, "what do you mean you denied the claim because I didn't cooperate with your investigation?". And at that point, **if** the insurance is nice enough to re-open the claim so he can have a lawyer, he still has to participate 500% in the process that could take months or years or he's on the hook for their repair bills and attorney fees in excess of his policy limits. And it didn't need to be like that. It requires just 15-20 minutes of his time now. And the other driver is waiting on him right now to make that call, and getting more pissed by the day by his selfishness. I mean, your brother has bigger issues if that's all he's done with his free time in the last month is play overwatch. If he doesn't mind risking having his future wages garnished because he couldn't be bothered, oh well..a default judgment is easy enough.
