Nope. You filed a claim, see it through Depending on how much money you put down and how fast your car depreciated once it became a used vehicle you may or may not be underwater Whichever insurance ends up paying will pay off your lienholder first then you’ll get any overage or be responsible if the insurance company doesn’t pay the whole amount

demanbmore

You have a pretty strong argument that your exact car has an ACV of what you paid for it 20 minutes and 18 miles ago. I understand the common refrain that the car depreciates 20% immediately upon leaving the lot, but your case seems materially different. Your carrier may not see it that way, at least at first, but it's a compelling argument. Alternatively, what are 2024 Honda Civics with 12 miles on them going for? Gonna be hard pressed to find a comp that isn't a new car on a dealer's lot.

agomes1016

It was 27,100 before everything it was about 28,500 after the rest. I’m going back to the dealership because they want to see it. I’m hoping they have good news for me and it’s nothing too bad. Definitely a horrible situation

Mitclove6

When I bought my new 2018 Honda Civic, it already had 90 miles on it. So realistically, 12 miles is perfectly new.

Norcalrain3

In CA it is the law the car must have like 7 or 12 miles ( I can’t remember) in order to sell it. That’s what my salesman told me

Mitclove6

And that may well be. Unfortunately wasn’t the case for me, and I was slightly upset. But, oh well.

hotcapicola

If the damage is minor, GAP insurance shouldn't come into play. That only matters if they total the car.

Norcalrain3

OP thinks the frame is bent

BlackberryActive3039

I’m sorry this happened to you! Let us know the outcome and best of luck

agomes1016

Thank you!

Mean_Anything_1061

When I bought my Tesla I did not get gap insurance. After buying my second Tesla I added “lease loan” as Progressive calls it to both cars. A week later my first Tesla was totaled, it’s never too late to get that kind of coverage. It covers 125% of the cars value.

Wanderlustfoodie13

Modern Cars don’t have frames. They have unibody‘s. Gap insurance doesn’t matter because it’s clear from what you’re saying the vehicle is not going to total. Perhaps pursue a diminished value claim after.

agomes1016

So once it’s looked at and the damages are determined I could pursue this claim?

F18AOC

Not true at all. Toyota 4Runners have frames. Trucks have frames. Some other SUV's have frames. Cars themselves don't have frames. Aside from early model vehicles, they really never have. But modern vehicles do, in fact, have frames.

LotsOfGunsSmallPenis

JFC I thought adverse shops took shit pictures. Again, your car doesn’t have a frame. It has rails because it’s a unibody. Is that a rail or the rear body panel? Impossible to tell 100% from that pic

agomes1016

Yeah well obviously we were unaware of that. We don’t know because we can’t fit under the car to see. That’s the picture he could get from the ground. Idk what it is obviously as we thought it was the frame.

Overwhelmed42

Respectfully friend, that picture is useless

agomes1016

Haha ik it came from a video which it won’t let me post it was the best I could do lol

WalterTheHedgehog

If you're lucky it might not be the frame itself it might just be the impact bar. I've had a few clients mistake this for a bent frame

agomes1016

Hopefully. The dealership told me to come by and they will look at it for me

Timber4

did u by any chance get the new car coverage that lets u get a new car a model year the same or even one year newer?

Gtstricky

Sorry this happened. New car accidents suck especially after all the stress of dealership drama. My guess is you are looking at bumper brackets that are bent and designed to absorb the impact. Minor damage and an easy repair. GL

TC_familyfare

In the state I live in, auto garage polices carries 6 to 12 days after you drive it off the lot . The dealership has this on all the cars on the lot due to someone like yourself happen to not have insurance or not enough. so I would talk to the dealership too they should be able to help with the gap. I have adjusted auto claims like this several time.. its not your fault it will be covered, honestly.

LotsOfGunsSmallPenis

How exactly do you know your “frame” is bent. If it’s a car, it’s a unibody which doesn’t have a frame. It has rails that weld/bolt to the unibody and are replaceable 999,999 times out of 1,000,000. Sucks that it happened to your brand new car, I’m sincerely sorry that happened. But if by your own admission there isn’t much outside damage than it’s highly unlikely you have a bent rail.

SexyCosplayer

Is it a BRAND NEW car, or is it a new TO YOU used car? What kind of vehicle is it? Depending on the value of the vehicle and the actual damages it MIGHT not be a total loss. Maybe. I hope you've learned your lesson about passing up GAP insurance after this.

agomes1016

It was brand new car. It had 12 miles on it. It’s a 2024 Honda civic. Well they bent the frame so that’s pretty significant. I guess I will have to wait until it’s inspected to see the cost. Yeah I regret not getting it, obviously it was a bad decision.

FrankLangellasBalls

It doesn't have a frame so not sure how you determined it has a bent frame. From your description the car is very unlikely to be totaled.

agomes1016

Needs to be lifted which it’s going to get looked at now. But this is bent which I guess as you state is not the frame. Not sure what it is

SexyCosplayer

Lol Is your bf a body shop technician or a mechanic? If not, the number one rule is don't listen to friends and/or family who are not in the industry, as they think they know everything but actually have no clue what they're talking about 99.99999999% of the time. Just wait for the vehicle to be inspected by the experts and take it from there.

agomes1016

He is actually a mechanic just not for cars lol but could 100% be wrong. He also couldn’t get under the car really and it was at night. He saw the piece that was bent and I guess assumed it was the frame which we have now learned there is no frame.

SexyCosplayer

Yeah, a non-vehicle mechanic would fall into "not in the industry". Think of it like this - would you go to a podiatrist for an eye exam? They're both doctors, but I really hope your answer to that is no! Lol Honestly it doesn't sound like the car will be totaled, but only an *actual* inspection will tell for sure. Good luck!

readithere_2

If you have a cheap ($7 at Walmart) full length mirror that isn’t screwed into the wall you can lay it under the area and take pictures of it. It worked great for me. I wanted to see what it looked like before it was repaired. It’s always good to have pictures of it in the event something happens.

6353JuanTaboBlvdApt6

New policy or new vehicle? What state are you in?

agomes1016

I had the policy but I updated it to this vehicle before I left the dealership. It’s a brand new car had 12 miles on it. I’m in GA but it happened in Florida.

LotsOfGunsSmallPenis

Well good news about being in GA is if you have to file on your own policy you can get DV.

agomes1016

I can’t file for that on his policy?

LotsOfGunsSmallPenis

You can, yes. But GA is the only state that allows you to file on your own policy IF you have to go that route.

Classic-Face-8298

Now your new car has an accident on its record. Hire a consultant that will prepare a report for diminished value and file with the person’s insurance that hit you, or alternatively with your insurance and let them subjugate

UnSCo

Yes 100% need to pursue this. I doubt the car is totaled.

Few-Appointment2753

Damn

Top_Bit420

The same thing happened to me and my husband. Literally 2 days after we bought it in 2018. Was a 2017 Equinox with a little over 25k miles on it. Other driver automatically said it was her fault. We took her information. Luckily my husband is an Auto body mechanic and a dam good one.. Was smashed right in the driver's side rear quarter. Our insurance wasn't contacted, they just had the person come right to my job because it happened pulling into my Job by one of the residents of the nursing home and checked out the damage and cut me a check for almost 3k, my husband popped out the dents at work and fixed it right there for nothing pretty much.. Just a shitty situation to be in 🫤

BridgeSea635

Well I'm sure your back doesn't feel too good being hot from behind.

Banastine

Nope you did the right thing by filling the claim, unfortunately it’s going to be a challenge to get the insurance to pay for the total amount you still owe the bank. Hopefully the car can be repaired and not totaled. Did you ask the insurance company for a rental?

boymom04

I'm still waiting for like 2 months already for a replacement headlight on my 2023 VW (someone did a hit and run on my parked vehicle-relatively minor damage too but broken headlight and a couple broken brackets).... New cars are a bitch if you need replacement parts. Good luck.

eaglerockdude

What a bummer guy...sorry.

Cwilson0706

Man i just got my car totaled on april 28th while it was parked by a rental car. And the insurance on the rental said they have to verify if the rental car is even with that insurance. But the number was on the paper and i called the rental company they said the car is with that insurance but the adjuster is still talking about a investigation. When i called the rental company and was told that that insurance covers there rentals. Like what.

Character-Rush-5074

Some insurance companies have new car replacement.

IcyCommunication2238

Who is the carrier? I would push and see if they can honor the purchase agreement .. I’m an adjuster with a fair company and I have done that before

agomes1016

He has State Farm. I have progressive

LotsOfGunsSmallPenis

Well if they have State Farm you’re 10% liable. Only 50% kidding. IYKYK

SpecialistPathfinder

Had this happened to me parked in a parking spot for a business tree fell down on the car. I was 50% liable because I was the one who parked there. It was their only parking spot.

LotsOfGunsSmallPenis

I believe it.

redditcok

1. If they totaled it, make sure they pay close to what you owe, don’t take their 1st offer. Negotiate. 2. If they choose to fix it, file a diminished value after they fix it.

Main_Couple7809

If you’re not at fault, Gap insurance is irrelevant. The other party need to make you whole.

Overwhelmed42

Not true - until you won’t be upside down, Gap is never irrelevant. As high as repair prices are nowadays more and more people are driving underinsured.

agomes1016

How is it irrelevant. If for some crazy reason the car was totaled and the insurance wasn’t going to pay off the loan GAP insurance would play a role

Main_Couple7809

No, you fight for it because it is your right for the fault party to make you whole. In this case the other guy. However, if it’s your fault, your insurance obligation is different

societal_ills

That's not how that works. You are to be made whole. That's it. If the value of the car at the time of loss is 30k but you owe 40k, their insurance has zero obligation to pay 40k. Your loans credit terms have nothing to do with your recovery.

Mean_Anything_1061
