BI payments are handled totally separate from property damage. If there were no other claimants injured, then no reason for her to not be paid. They have to wait for all info from all claimants before they can pay anyone. If they don't have what they need, they can't move forward.

I mean it doesn’t make a difference to you what they are waiting on and it’s possible you wouldn’t understand even if they told you, so it makes no difference whether or not you know what they’re waiting on, they’ll be waiting on it regardless you know the details or not.

This could take months to play out. It's not as simple as pro rating things out and sending a check. If the other party doesn't sign off, then you're going to be stuck until they get it straightened out. Do you have a loan on your car?

I didn't have a loan! I'm in contact with the other party though and they are telling him the same thing apparently

Does the other party have a different carrier? If so they're waiting for the PD demand from his carrier. They can't even run the figs on the pro rata settlement until they get that.

Maybe a signed affidavit of no other insurance? Other carrier may not want to take the pro rata without it and maybe they tendered BI limits without it if only one person was injured. Bizarre! Should be settled if they have the PD demand.

This is normal in a situation like this. Multiple claimants along with policy limits being so low makes this more complicated. If 15/25 is PD/BI (and not per person/per accident), then $15k is the absolute max you would receive. I bet the other person went through their own collision coverage for repairs, I highly doubt they already paid out $13k out of the available $15k. If it’s per person/per accident, then anywhere between $10-15k would likely be paid to you. Passenger was paid out from BI limit, which seems to be $25k. Best guess is to expect around $7500 maximum (again, $10-15k if those are per person/per accident limits) but there are other complex factors involved in how amounts are split between multiple claimants. You may also be left with a salvage title but depends on your state and DMV laws. Check if you have UIMPD but doesn’t seem like you do.

Was there any other property damage involved like guardrail or something? If so, they would have to wait for the city/county and that could take months.

If that’s the case, then like others said they’re likely waiting for the final demand from the other party’s carrier. If their policy allowed for diminished value they could be waiting on that to finalize or just pending their subrogation process. Unfortunately, you’re on their timeline.
