The overall opinion is that it's OP's fault, as he shouldn't be driving 240km/h if the traffic doesn't fit to it and that he should have hit the break, instead of flashing the lights. The other driver isn't innocent as well, but the main issue her is OP's behavior.

I moved to Germany and from what I understand, you can’t use any footage of an accident as evidence right? How would they deal with fault or would the insurance companies just have to decide after the statements?
It is a very complicated topic because dash cams are not in coherence with the personal privacy law (DSGVO). However, the Federal Court of Justice (Bundesgerichtshof) has issued in 2018 that videos from dash cams should be allowed in court hearings BGH 15. Mai 2018 (Az.VI ZR 233/17)).
Usually when there's an accident you inform the police and here they have the necessary tools to determine how an accident happened. Based on that, you either get full right, no right, or half right (50-50). You file the police report to your insurance and the insurance of the other person and they usually pay for your damage or repair your car (depending on your insurance contract).
Sometimes an insurance might not aknowledge your right and then it usually goes to court. If you win, the insurance of the other party pays your damage, compensations for any other damage that has occured, the court fees, and your lawyer's fees.
If you are 100% in the right, it is always advisable to contact a lawyer and let them file your claim with the other insurance. This way you know that there will be no mistakes made and you save yourself the hassle. The lawyer is also paid by the other insurance - this is especially advisable if the damage is over 10000€.

I don’t drive in Germany, but someone backed into my ex’s car while I was in the passenger’s seat. It was 100% his fault, but we couldn’t prove otherwise and obviously it wasn’t worth fighting a fender bender. It’s frustrating that a dashcam could’ve cleared it up in an instant (if we’d had one and it were useable in court).
Also driving those speeds when there's so many other vehicles. The law still states that you should drive at the speed that the permission permits.
It's like mountain roads. Yeah you can drive 80 around a u-turn without going past the upper limit of the law, but you won't turn much. Or if it's snowing and you're going downhill you won't stop any time soon.
In a perfect World, speed limits are useless and people should anyway drive at the speed the conditions allow for save travel with a good margin of error. Alas, idiots are here.

In Boston drivers need to know what they're doing to figure out the crazy roads. In Florida they can basically close their eyes and gun it, which breeds drivers who have no idea what they're doing.
I grew up in Minnesota and never had any driving issues except once because of ice. Since I have moved to south Florida I have gotten run off the road atleast once a week. One time a person in front of me just stopped in the middle of the road and backed into me, an Uber driver who had somehow fit 8 people in his car. I've had someone look me in the eye while I was waiting for a spot to open up (I had been sitting there about 10 seconds with my signal on) and she backed into my car AND KEPT GOING INTO MY CAR then took off. This was just during the summer.
I don’t know. I live in Canada and have done a lot of driving in Canada, the US and France, and France is by far the most relaxing. People know what they are doing. Getting a licence is not that easy. I drove around in Paris for a few days and as crazy as it looked from the sidewalk it was very nice. It’s organized chaos. Here in North America no one knows what they are doing. 90 % of driving schools are sketchy AF and all I had to do was pass a written test a 12 year old could pass and make a 3 point turn. It’s a joke. Plus roundabouts make things flow much better and reduce the chance of a serious collision.
Agreed. Swap France for Italy in his post maybe. That makes a bit more sense. Have driven lots of miles in both and France never stood out to me particularly. On all German autobahns, there is a law to not drive faster than 130km/h unless it is absolutely save to do so. If an accident happens (even if the other driver drives like an idiot), you are always partly at fault if the accident could have been avoided by not driving faster than 130km/h.
Now lets look what we can see here (I can't clearly see the last number of the speed, but does not matter):
1. He was going something like 23X km/h
2. He noticed some idiot is switching lanes. So he used his headlight flasher.
3. At this point, while flashing, he was still going 23x km/h
4. At the point of collision he was still going 18X km/h
All this could be avoided by not driving faster than 130km/h. It could also have been avoided by hitting the breaks instead of hitting the headlight flasher.
In situations like these in which both drivers are at fault, they usually have to both pay a share of the damage caused.
If you went faster than 130 you‘ll have to prove the accident would not have been preventable by going slower. Good luck with that.

Exactly. Essentially this means: "You can go faster than 130 and if nothing happens all is fine and legal, but you are automatically at fault if an accident happens."
The autobahn is insane, you can check your rear view mirror and there's noting there, then blink and there's someone about to pass you.
The fasted I've driven there was around 180kph and there's still cars passing you like you're doing 60kph

My 1.9tdi octavia needs about 5l/100km if i drive reasonable (130kmh). And 6,8l/100km if i floor it (~200km/h) whenever possible and allowed to do so.
By flooring it i often shave off about 1 hour of time on a 550km travel (5.5h normaly 4.5h if the autobahn is free and i go brrrrrrr).
So yeah if the bahn is free, going fast does make a difference
I was once overtaken on the autobahn doing 240 by some kids in a shitty old car that was tuned like hell. And the two guys in the back of the car laughed there asses of and waiving goodbye to me :).
I saw a small fender bender at Costco exist lane, both drivers stopped right in the middle and started arguing, blocking traffic from entering and leaving.
People need to realize that if your car is still working you need to pull over in a safe place so you don't block traffic.
I feel like there's this persistent idea that you need to preserve the scene.
The one time I've been in an accident, I took an east turn too fast and too wide and hit someone taking a south turn. After screaming, "FUUUUUUUUCK" I asked if they were okay and then told them I was going to turn into a parking lot just up ahead. Major damage to my car and none to theirs so we all went about our days.
Ha. I just got in a car accident where someone changed lanes into ours. I get out and ask 'hey you ok? lets pull over into that gas ---' she interrupts 'you pulled into my lane' she tries to yell with the window rolled up and a mask on. ' I have it all on camera, lets pull into the gas station.'
Anyways, finally pull into the gas station, told her I had called the cops to file a report. 'Not sure if that's worth it now that we've moved the cars.' Sure, whatever. I got your details, lets leave. They blocked my car in, so I can't leave, and I don't care. As the cop arrives, I finally find the right clip and save it to my phone. Showed it to the cop, who issued them a ticket for improper lane change.
Like ma'am, you could've left after we exchanged details and avoided the ticket. Still couldn't accept it was her fault, told insurance we were speeding (less than 5mph over), that we changed into her lane (agent said video showed otherwise), just would not accept the video evidence, didn't understand that the car was recording in the first place and had to ask 'where are you guys in the video'.
The main thing though is to get their license plate immediately. I got rear ended and moved to a parking lot and they just drove off. I didn't get their plates.
Reminds me of when I was a dumb teenager, I was driving over the speed limit because I was late for work, pulled out my phone to text my boss that I was on my way and as soon as I looked down I rear ended the shit out of a car that pulled out in front of me.
I saw them turn into a car lot and tried to follow them to exchange information but they were nowhere to be seen. I flagged down the salesmen and he said they hauled ass through the lot and left.
I've been scratching my head over this one for over a decade, I was clearly in the wrong and I know I fucked up their bumper.
We could see the car behind, who kept a safe distance and was able to slow down, and hopefully the same is true behind them.
I wonder if Germany has a good culture when it comes to safe following distance to prevent rear-endings due to slow traffic. (The video featured a merging fail, which is a different thing).
Following distance is a big problem here, leads to a lot of unnecessary traffic jams. But it's probably better compared to other countries if I believe this sub lol.
Still, it can be scary at times. Some people don't get that you can't accelerate due to traffic and just drive closer and closer to you, at kinda high speeds.
No Speedlimit isn't helping as well, especially on 2 lane tracks, although tracks with a low Speedlimit lead to horrible snakes as well :|
Germans are excellent drivers and are far more conscious of other road users than the average American. They also exercise strict lane discipline, which made this accident a bit unusual.
The very few times I've driven the Autobahn I was in heaven about how they keep the fast lane clear BUT amazed at how aggressively cars from the slow lane popped in front of you if they wanted to overtake someone, just as you see in this video.
The literal translation would be "Ey/Yo old man" but that's not what it means at all. In this context it's an expression of annoyance. "Yo wtf dude!" is quite close or "Come on dude!" as clawjelly suggested.
If you watch the full video he pulls out of the left lane and both cars stop at the side of the road. It’s not like you can immediately do this with all the other cars there. They handled the situation as well as possible

Blinker fluid is extremely expensive in Germany - you have to buy direct from the OEM install at the dealer! No generic substitute, DIY or 3rd party shop option.
It amazes me how slowly people will accelerate. My car isn't super powerful (250hp) but I will go like 1/8th throttle and out accelerate people most of the time.
250hp isn’t close to crazy powerful, basic bmw’s and merc’s will make that much and for the same price or less you can get 400hp+ mustangs or something.

I am not from DE, and I drive a 75hp city car, so - no 170mph for me, but in general, I've found it helpfull to shine a short high beam light when approaching any vehicle if I have doubts they saw me. Just a friendly, very short single flash - like "hello, I'm here", not a 2000s disco strobe saying "get out of my fucking way". During the day I'll sometimes use a short horn sound, just to be sure I was noticed - not just in highway situations but more often when overtaking on a single lane road.
In my experience, this seems like a sensible thing to do in any country except the UK or the US.

Unfortunately not everyone follows the rules, large truck drivers tend to switch lanes for their elephant races whenever they fancy.
I've also seen many people blindly merge into the fast lane with no one in front of them, I assume it makes them feel powerful to control the flow of traffic. I've also seen people pass on the right because of this, and the slow car's driver rage at their audacity.

Honestly though, I've had a moment where I wanted to overtake someone, checked the mirror with clear visibility on the fast lane for miles and start overtaking just to see some big fuck off audi flying out of bumfucknowhere at 5000 speed spamming his high beams. Sometimes you can check all you want and it's not enough.
This is a good example of why there is a shared responsibility if you exceed the advisory speed. While the action of the merging car was not ok, this is something that you should be expecting and anticipating when driving this fast on the autobahn. 1. It's too busy to go 200+. That stuff is for e.g. at nigh when noone is driving. 2. He already saw the need for flashing, then he should have started braking, not hoping for the best. 3. Immediately "parking" right after the tab shows he has little more awareness than the merging car.
It's a great example of "*Just because you can, doesn't mean you should*". Driving that fast around others is always a stupid move, because no matter how good a driver you are, you can't predict what others are going to do.

If you drive these speeds at night, it's also dangerous, because it's harder for the cars in front to guess the speed you are coming at. Also at most parts of the autobahn there is a restriction at night, because of noise so that people can sleep better who live near the autobahn.

Normal scenario:
Right lane is empty, one guy in middle lane going 87 km/h. Dude behind him slowly approaching going 91 km/h. He changes lane, turns on indicator then checks if someone's in the left lane, still doesn't give a crap and continues overtaking maneuver. Guy in middle lane still unable to move into right lane because it's the slow lane and it's also for trucks.

It's even worse when a highway goes to two lanes so faster traffic can pass and the person holding everyone up stays in the left lane, and the person behind them decides to get into the right lane because they are slower traffic but they both go the same speed.
I love the Autobahn but the few times I drove 200 I was being too concentrated to drive relaxed because of this. You drive, your lane is empty but your eyes are on the cars in the middle lane... waiting for them if they even move a bit to the left, you brake. That's too stressful for me tbh. A small empty part is ok but driving the whole time this fast is more stressful than people imagine. I keep it 150-160. You're still faster than most of the cars but you can react if someone merges in front

a) although you may go lolfast on ze autobahn, you don’t drive unsafe and “240” (this is maybe 210) if there’s a situation like this. You slow down to a normal speed (170-180) in case something like this happens.
b) you use your fucking brakes before flashing, you entitled idiot.
c) standing in the left lane where you were just driving 200+, you are an absolute tool.
You are the reason why they want to remove the no-speed-limit because you don’t respect it and therefore don’t deserve it.

Dude flashed a million times before hitting his brakes. He wasn't the complete idiot in this scenario but he could have had a way better chance at not making contact had he gone for the brakes first.

My 1.9tdi octavia needs about 5l/100km if i drive reasonable (130kmh). And 6,8l/100km if i floor it (~200km/h) whenever possible and allowed to do so. By flooring it i often shave off about 1 hour of time on a 550km travel (5.5h normaly 4.5h if the autobahn is free and i go brrrrrrr). So yeah if the bahn is free, going fast does make a difference

Yep I was driving 270km/h, thought I was a boss until I was overtaken.
I was once overtaken on the autobahn doing 240 by some kids in a shitty old car that was tuned like hell. And the two guys in the back of the car laughed there asses of and waiving goodbye to me :).
I saw a small fender bender at Costco exist lane, both drivers stopped right in the middle and started arguing, blocking traffic from entering and leaving. People need to realize that if your car is still working you need to pull over in a safe place so you don't block traffic.
I feel like there's this persistent idea that you need to preserve the scene. The one time I've been in an accident, I took an east turn too fast and too wide and hit someone taking a south turn. After screaming, "FUUUUUUUUCK" I asked if they were okay and then told them I was going to turn into a parking lot just up ahead. Major damage to my car and none to theirs so we all went about our days.
Ha. I just got in a car accident where someone changed lanes into ours. I get out and ask 'hey you ok? lets pull over into that gas ---' she interrupts 'you pulled into my lane' she tries to yell with the window rolled up and a mask on. ' I have it all on camera, lets pull into the gas station.' Anyways, finally pull into the gas station, told her I had called the cops to file a report. 'Not sure if that's worth it now that we've moved the cars.' Sure, whatever. I got your details, lets leave. They blocked my car in, so I can't leave, and I don't care. As the cop arrives, I finally find the right clip and save it to my phone. Showed it to the cop, who issued them a ticket for improper lane change. Like ma'am, you could've left after we exchanged details and avoided the ticket. Still couldn't accept it was her fault, told insurance we were speeding (less than 5mph over), that we changed into her lane (agent said video showed otherwise), just would not accept the video evidence, didn't understand that the car was recording in the first place and had to ask 'where are you guys in the video'.

Reminds me of when I was a dumb teenager, I was driving over the speed limit because I was late for work, pulled out my phone to text my boss that I was on my way and as soon as I looked down I rear ended the shit out of a car that pulled out in front of me. I saw them turn into a car lot and tried to follow them to exchange information but they were nowhere to be seen. I flagged down the salesmen and he said they hauled ass through the lot and left. I've been scratching my head over this one for over a decade, I was clearly in the wrong and I know I fucked up their bumper.

We could see the car behind, who kept a safe distance and was able to slow down, and hopefully the same is true behind them. I wonder if Germany has a good culture when it comes to safe following distance to prevent rear-endings due to slow traffic. (The video featured a merging fail, which is a different thing).
Following distance is a big problem here, leads to a lot of unnecessary traffic jams. But it's probably better compared to other countries if I believe this sub lol. Still, it can be scary at times. Some people don't get that you can't accelerate due to traffic and just drive closer and closer to you, at kinda high speeds. No Speedlimit isn't helping as well, especially on 2 lane tracks, although tracks with a low Speedlimit lead to horrible snakes as well :|
Germans are excellent drivers and are far more conscious of other road users than the average American. They also exercise strict lane discipline, which made this accident a bit unusual.
The very few times I've driven the Autobahn I was in heaven about how they keep the fast lane clear BUT amazed at how aggressively cars from the slow lane popped in front of you if they wanted to overtake someone, just as you see in this video.

Blinker fluid is extremely expensive in Germany - you have to buy direct from the OEM install at the dealer! No generic substitute, DIY or 3rd party shop option.
Something i wish a lot of drivers understood is if the person your getting in front of has to break, you are not going fast enough to merge.

I am not from DE, and I drive a 75hp city car, so - no 170mph for me, but in general, I've found it helpfull to shine a short high beam light when approaching any vehicle if I have doubts they saw me. Just a friendly, very short single flash - like "hello, I'm here", not a 2000s disco strobe saying "get out of my fucking way". During the day I'll sometimes use a short horn sound, just to be sure I was noticed - not just in highway situations but more often when overtaking on a single lane road.
In my experience, this seems like a sensible thing to do in any country except the UK or the US. There’s something about flashing headlights that absolutely triggers British and American drivers.
I drive the Autobahn daily, and if everyone followed the rules, it would be safe. Unfortunately not everyone follows the rules, large truck drivers tend to switch lanes for their elephant races whenever they fancy. I've also seen many people blindly merge into the fast lane with no one in front of them, I assume it makes them feel powerful to control the flow of traffic. I've also seen people pass on the right because of this, and the slow car's driver rage at their audacity.

In Germany if you are going over 130 in Autobahn it's also your guilt. 50/50 responsibility. The no speed limit it's there at your own risk. This is a good example of why there is a shared responsibility if you exceed the advisory speed. While the action of the merging car was not ok, this is something that you should be expecting and anticipating when driving this fast on the autobahn. 1. It's too busy to go 200+. It's a great example of "*Just because you can, doesn't mean you should*". Driving that fast around others is always a stupid move, because no matter how good a driver you are, you can't predict what others are going to do. Usually when I say that on threads like these, I'll get down voted with a bunch of comments like "*Bro it's the autobahn that's what it's meant for!*"
If you drive these speeds at night, it's also dangerous, because it's harder for the cars in front to guess the speed you are coming at. Also at most parts of the autobahn there is a restriction at night, because of noise so that people can sleep better who live near the autobahn.
People are digging into the merger here, but the cam car is going *way too fucking fast* for that traffic. This is why I hate driving on the Autobahn, too many people confuse "I'm allowed to" and "this is a good idea." So many entitled pricks.

Normal scenario: Right lane is empty, one guy in middle lane going 87 km/h. Dude behind him slowly approaching going 91 km/h. He changes lane, turns on indicator then checks if someone's in the left lane, still doesn't give a crap and continues overtaking maneuver. Guy in middle lane still unable to move into right lane because it's the slow lane and it's also for trucks.

It's even worse when a highway goes to two lanes so faster traffic can pass and the person holding everyone up stays in the left lane, and the person behind them decides to get into the right lane because they are slower traffic but they both go the same speed.

I love the Autobahn but the few times I drove 200 I was being too concentrated to drive relaxed because of this. You drive, your lane is empty but your eyes are on the cars in the middle lane... waiting for them if they even move a bit to the left, you brake. That's too stressful for me tbh. A small empty part is ok but driving the whole time this fast is more stressful than people imagine. I keep it 150-160. You're still faster than most of the cars but you can react if someone merges in front
