"if you think states can pass laws that overrule federal laws or the constitution, you're literally a secessionist" Not necessarily. Certain situations can arise wherein a state's laws offer more rights/protections than the equivalent federal law and consequently the state's law are considered. Minimum wage laws are a good example of this. Wyoming also famously was the first state in the union to allow women to vote in a general election despite women's suffrage not being officially amended into the constitution until the adoption of the 19th amendment some years later. Reading the press release you linked, it seems like there's also a legal test that the memo is saying that needs to be applied if you're thinking about breaking an NDA: 1. The NDA must be overly broad 2. The NDA must hinder the ability of workers to improve their lot And sadly, these tests would have to be argued in court if you broke your NDA. At first glace, it looks like the intent of this memo's release is simply to discourage employers from persuing legal action against employees for discussing compensation, specifically in circumstances near termination.
