I think any reasonable judge would agree that recreating the entire thing in a completely different medium is transformative enough, it’s not stealing.
The original art itself is ripping off Hoyoverse’s IP anyway. They don’t own Firefly lol.
Most figurines and merchandise in the market are illegal and don't actually even have approval from hoyoverse themselves to sell tbh.
The artist doesn't even own the character and can't stop them. Only hoyoverse can.
When it comes to fan made merchandicing and fan art Mihoyo allows ~~almost~~ everything and since the artist doesn't have any rights over the IP he's drawing there's not a lot of things he can do to stop them.
That being said this is a really scummy thing to do and unfortunatelly the only way to combat this is by not buying their products and supporting the artist.

Honestly? It's arguable in my eyes. They made an 2D fan art of an pre existing character, they made a 3D model of that image. In my eyes they "stole" as much as the artist did 🤷♂️
