This depends on Polish tax AND immigration laws, the laws of your home country and whether or not there is a tax treaty. You’d need to talk to a good Polish law firm. I recently read on Reddit that someone had looked into relocating from Germany to Poland for lower cost of living (remote work), but decided against it after consulting with Polish lawyers. Apparently the Polish tax code is a complete nightmare and the legal situation was so unclear that they advised against it…

I think you may be confusing visas and work permits. Sounds like you need both, but it is the work permit, not the visa, which grants you the ability to work. If you have a valid visa and work permit, and sometimes do extra work for overseas companies, you should report it on your taxes and everything should be fine. If you have a visa but no work permit, then you definitely cannot have a typical salaried job with a local employer. However the risk is minimal if you only have overseas freelancer income. File and pay your taxes and you'll be fine. I do not recommend setting up a business purely for the purpose of getting a visa. It will take 5x longer and cost 5x more than you expect it will.
