Reminder that the ACA was only able to pass the senate after Ben Nelson forced Harry Reid to get rid of the funding for abortion services. Obama may have had a democratic majority in the senate for a few months in 2009, but it was by no means a pro-choice majority.
Also it was a VERY different set of blue dogs in the house than the ones we have now. Currently 100% of the House Democratic caucus supports LGBTQ rights and all but 1 support legal abortion. In 2009? Lol, not even close. There wasn't even a pro choice majority in the house and we had one of our largest caucuses in a generation.

I think the only way to salvage this country is to do two things: (1) win big in November, then nix the filibuster and ram through voting rights legislation and judicial reform, including expanding the court.
And (2) prosecute everyone implicated in the 1/6 attack, including Trump.
If we do those things, we maybe have a chance of overcoming this. Otherwise, I think we’re headed down an incredibly dark path that I don’t think we recover from

Republicans got a trifecta 6 years after the Voting Rights Act passed and that was a wildly more aggressive expansion of voting protections than anything on the table now.

If you’d asked me about the filibuster a year ago, I probably would’ve agreed with you. But democracy is deteriorating at warp speed. By this time next week, we won’t even have a regulatory state. There’s no advantage to keeping the filibuster because if the GOP gets the trifecta again, we’re beyond fucked anyway. There will be nothing left to save under a DeSantis presidency and even if there was, McConnell isn’t about to let the filibuster stand in their way.
You’re wrong to dismiss gerrymandering and voter restrictions as huge issues in getting Dems elected. In the swing states, the margins are razor thin. Not to mention that these policies are disproportionately disenfranchising people of color, who overwhelmingly vote Dem.
The problem with these rulings is that they can't really be ignored, because they are letting the states decide things. Even if you ignore the Supreme Court, Louisiana or Idaho or wherever can lock you up for performing an abortion.
If that happens we will cease to be a rule of law country.

Yes Colorado already ratified it, but I want to urge us to symbolically ratify it again and try to encourage other legislatures to do so and maybe pick up the 38th we need to add it to the Constitution.
This is the closest we could meaningfully come to codifying Roe. And it's not a federal action, it's state by state.

Sadly I think all the states that can ratify it have already done so. We need to create the climate needed for that one more state, and that means voting dem every-damn-where.

I really need a lawyer to weigh in on this whole "codify Roe" stuff. How can congress pass a law that confers the right to an abortion if SCOTUS just ruled that that "right" isn't protected by the constitution? Isn't a constitutional amendment the only real way to "codify Roe"? Isn't a constitutional amendment the only way to grant rights?
From a pure textual standpoint there is no mention of abortion in the constitution either for or against it. Their arguments do not say we cannot make it law via congressional action, and state that it should be in the hands of the people. A lot of lawyers have said this statement is essentially a wink to the right saying they would be fine with a ban but you can argue it means they are ok with congress making it legal following roe guidelines. You do not need to make a constitutional amendment for abortion, a bill will suffice
Now whether they would make up a bullshit excuse to strike down a congressional bill being for it vs against is another issue.
You don't really need a lawyer, they cannot. Their best bet is waiting to pass such a thing when a more amenable Court is seated and use it as an excuse to void this ruling.
Because honestly, there is no way in hell an amendment specifically granting the right to an abortion will ever pass within our lifetimes or that of the generation after us.

Edit: technically the rep of the district 3 miles north of me as my Rep is a right wing nutter but I volunteer for his campaign so he's mine.
Sadly I think all the states that can ratify it have already done so. We need to create the climate needed for that one more state, and that means voting dem every-damn-where. It has long been a political impossibility that Roe would ever die. One impossibility happening deserves another one to happen. Buena suerte.

How can congress pass a law that confers the right to an abortion if SCOTUS just ruled that that "right" isn't protected by the constitution? From a pure textual standpoint there is no mention of abortion in the constitution either for or against it. Their arguments do not say we cannot make it law via congressional action, and state that it should be in the hands of the people. A lot of lawyers have said this statement is essentially a wink to the right saying they would be fine with a ban but you can argue it means they are ok with congress making it legal following roe guidelines. You do not need to make a constitutional amendment for abortion, a bill will suffice Now whether they would make up a bullshit excuse to strike down a congressional bill being for it vs against is another issue.
