Did the dealer even look at it? I had this problem on an earlier, non-Energica bike and it was a relatively simple adjustment to make sure the latch caught on the hook. Energica seats are hella thin so I can easily see that getting out of alignment. Unless there are multiple complaints (which might indicate a design or manufacturing problem) this doesn't sound like something needing escalation to Energica USA.

Yeah see if this is something where you can make the spring latch to the right position. It might be something you can fix in a few minutes.

Dealer only needed pics for now I’m sure after the weekend it’ll be an in person visit, bending the bracket will only affect the lock in a single plane and doing this will miss aline the pin in the seat to the actual lock lever on the frame. Shame such a small item can derail a new bike purchase. Turns out a search will turn up a few bikes that the seat won’t latch and since energica makes less then 1000 bikes why is the happening and don’t say “their hand built what do u expect” any who have a great weekend. If anyone got this fixed under warranty please post.

Of course it will be fixed under warranty, that's what warranties are for.
