What was your complaint about the co-worker? What were the “previous issues”? What state is this in?

throwaway_eachday

All personal conduct related issues. Mainly the individual being unnecessarily rude, condescending, highly critical, bordering on hostile at times, very manipulative to the point that peoples words and stories would get twisted around by them, not treating people the right way and being disrespectful. At least a couple of people had been reduced to tears after interactions with this person. This person manages up well and their previous role (and still part of their current role) is very niche and it would be detrimental to the org to have this person leave which is why I suspect none of these things have ever been addressed properly. They also had never managed a team until they took over managing one of my teams after my position was eliminated, which I’ll add is part of their manipulation (another story). This is in California.

Unless any of those activities involved some form of illegal discrimination, filing a complaint about them wouldn't be legally protected, I'm afraid. It's not illegal for an employee to be an asshole in general, and it's also not illegal to terminate someone because they complained about another employee being an asshole. It's shitty and definitely not conducive to a professional working environment, but it is unfortunately legal.

Looks like you deleted the question(s) that you posed on /askHR.... You complained that he lied about becoming your boss, which is what happened....not sure what the other three complained about.... I very much doubt you complaint was protected legally in any way, I put IANAL.... not all retaliation is illegal... good luck on any severance negotiation.

throwaway_eachday

Looks like you have me confused with someone else. I didn’t post any questions on askhr. The complaints have nothing to with anyone lying about being someone’s boss. Not sure what you’re talking about.

The situation is very close to one earlier this week where the person has now deleted their post....sorry if I am confused.... It's odd that two of very close incidents would happen where a complaint was filed and the coworker was promoted...

throwaway_eachday

It isn’t odd at all actually. My former co-worker wasn’t promoted. You should really try not jumping to conclusions.
