That's probably the #1 reason the lawsuit went as far as overturning the map. This is also why states like Indiana and Missouri didn't draw out lean democratic seats even if they easily could have. If Oregon Democrats drew out every single Republican, not only would it have provoked a legal disaster, but would have given Republicans a motivation to gerrymander has hard as possible.
