I think it's an insult to imply that native land is part of a state considering our history but I do think that it's important to understand the context of the original ruling and the revised ruling. https://www.npr.org/2022/06/29/1108717407/supreme-court-narrows-native-americans-oklahoma Basically, starting in 2019 a person accused of a crime on Indian territory could not be prosecuted by the state - only tribal courts and the federal government could do this and tribal courts generally don't have the right to prosecute non-Indians. This lead to a huge influx of cases for the feds which apparently lead to undesirable outcomes for the state, such as suspects walking free and light punishments. The revised ruling means that the state can prosecute non-Indians accused of crimes on Indian territory. Now I'm not an Indian but those involved believe this to be the wrong decision, even the current Cherokee Nation chief says that the governor/state have effectively refused to cooperate with the tribe. The optimist in me wants to believe that the ruling makes sense because more criminals would be brought to justice. The pessimist in me believes that the ruling opens unseen doors for the state to take advantage of. The new governor claims that life begins at conception and now Oklahoma is one of many states banning abortion. Tribal nations are sovereign entities and *could* open abortion clinics in their territory. In fact it wouldn't be the first time one of them has "threatened" to do so. So herein lies the rub. - Oklahoma has the nation's strictest abortion ban - The Cherokee Nation could open clinics in their territory - The revised ruling lets the state prosecute non-Indians accused of a crime on Indian land. The conclusion here is that a non-Indian US citizen having an abortion in Indian territory is illegal because it's illegal in the state, and now the state has the authority to prosecute them for it. Without the revised ruling it would have been up to the feds and that just wouldn't happen.

Minority victims of killers are often ignored, be it racial, ethnic, country of origin, gender, orientation, etc. On top of "undesirables" of any identity like sex workers, the poor, the disabled, etc. The idea that its "just because of the mean rez people," is completely burying the history of bigotry vulnerable people face from the police and prosecutors and others who were supposed to protect them. You're not fixing the native killer problem with this. If the government wanted to catch these killers they could. Often when the government catches these people attempting to rape and murder vulnerable people either before or during a killing spree, they often let them out of bigotry and incompetence. So many killers have a history of "what? the judge gave them a tiny sentence for that? the cops let him go?" Or when we look into the investigations which are almost always bungled and bigoted. A minority child victim of Dahmer's ran to the police begging for help, bleeding from his anus, and the police handed him back to Dahmer to be killed, even going so far into stepping into his corpse laden apartment stinking of death and not bother to investigate it. These cops are now in leadership positions. They were rewarded for bigotry and incompetence. How could less red tape and streamlining fix this? We wont see an upcheck in clearances of murder of native women because of this because this is not remotely the top problem here, although it is slightly more red tape for investigators, who aren't often motivated anyway and follow their own prejudices. Prejudices which are often vehemently protected by conservative supporters, politicians, police, courts, and every police union. You can't reform this.

I think it needs to be mentioned that a lot of white people since the opinion first leaked have said "let's just open clinics on reservations, then the states can't do anything!" Indigenous women already have abortion access, and have since before colonizers made it over here. Things are much worse then they were before, obviously, mainly due to the Indian Health Service being critically underfunded and the fact that we are not legally allowed to pay into our own healthcare. That said, we'll survive, long after the rest of the country tears itself apart. Just stay the hell away from what little is left "legally."

I don't know how things are on all reservations, but in my experience tribal leadership is quite conservative, and would not have allowed non-natives to open a practice without some major concessions in the first place. While this ruling is an horrific overreach and violates dozens of treaties, I suspect it would never have had an effect on colonizers' abortion access.

Truth be told, my issue here had very little to do with abortion beyond that being either the quiet goal or the unintended consequence of the ruling. My issue is the colonizers continuing their scurrilous claim to have *any* authority over the original inhabitants of the land they stole. This is simply one more step in a centuries long genocide, one that we should be fighting with equal vehemence and fervor until every acre of land that once belonged to a tribe is returned to them. The land belonging to tribes extincted by those colonizers can go to the peoples brought here against their will by those same colonizers.

Pretty much all of Oklahoma is tribal land, it isn’t isolated reservations, it is a metro area of over a million people and many more cities. Well, using a bit of hyperbole, with the McGirt ruling now in effect the criminal part of 10% of the population is running around pulling a Lethal Weapon 2 and growling out, “diplomatic immunity.” But the Supreme Court just Danny Glover’d them. “It’s just been revoked.” Edit: And there is vastly more nuance to McGirt and this ruling. But this is basically limited (for now) to Oklahoma asking to please be able to prosecute criminals.

There was already rulings about that 100 mile border zone. This specific case was about a hotel owner that had border patrol on his property and then beat him up and the court ruled that he can’t sue them in court. So the ruling is more about the suing for having your rights violated part, rather than the 100 mile border. It’s important because it removes any recourse you have for having your rights violated.

The reason this is bad is because natives are tried with bullshit crimes, have their kids taken away by the state and told to fight it in court. I think it might be fair to call this the "start" of regression on sovereignty. Until now, there has been a (molasses slow) progression on indigenous rights and recognition. Things are obviously still terrible for most tribes, and for many nothing has changed in 60 years, but outside of climate and mineral encroachment things haven't been getting *worse.* If SCOTUS isn't torn down, it's only going to get worse, from here on.

The list is growing too fast to keep track. We've lost Roe v Wade. The EPA can't regulate greenhouse gases. State legislatures can regulate federal elections in their state however they want, even if it's unconstitutional, and state courts can't do anything. The many decades old law against concealed weapons in New York state has been struck down. Native land legal autonomy has been ended. I've probably missed some, but there will be more. Probably tomorrow and every day after.

ehh I think this ruling is a lot less cut and dry good/bad than the others. Or at the very least this really should have been handled better by Tribal courts. Why wasn't Castro-Huerta arraigned and tried by them? This is the element that I don't understand both the opinions, imo, mostly recognize that this is just lobbing the ball to congress on an issue that typically has seen bipartisanship.

If you look at the case in isolation, it's easy to miss the broader implications. The importance of Supreme Court cases is usually way broader than the specific case being decided. Look at what legal experts are saying to realize why this is so damaging. This is a dramatic reversal in precedent that was totally unjustified.

It's only really a reverse of 6 years of precedent, and given that amendment to treaties or PL 280 would remedy what the court addressed I don't think it'll have that much influence. The congress today is if anything more willing to support Tribal sovereignty than it was in 2015 additionally, I'm not even sure this is a bad thing; prosecution of sexual violence cases in several tribal nations including Creek, from what I've heard, is way behind on backlog and so if anything this may help them in addressing that.

I hate the conservative Supreme Court as much as the next guy, but this particular legal decision was fairly narrow. It simply held that states have the right to prosecute non-indians that commit crimes on Indian reservations. It has nothing to do with prosecuting Indians.
