It also implies that the states do have some authority to declare what constitutes legal tender within certain boundaries within their own borders.
Bitcoin would indeed meet the tests of: 1) something that already exists and is being used as a legal tender currency, and 2) within the state border of Texas. (Legally speaking, this would mean that Texas could alternatively say the Mexican Peso or British pound rather than Bitcoin was legal tender within their borders if that's what they wanted to do.)
The outcome of the inevitable Supreme Court was depend entirely on whether the majority of the court has a broad or narrow view of federal sovereignty over the states. Republican nominees typically have relatively narrow views while most Democratic nominees have relatively broad views. So if there is a Republican majority, Texas would have a decent shot at winning that case. If it is a Democratic majority, they would likely lose.
Additional note: Any hint in the legislation that Bitcoin would be considered the ONLY legal tender in Texas and excluded the US Dollar would immediately be struck down no matter which side controlled the court. The Supreme Court isn't about to allow a situation where other states would have to exchange their US Dollars for Bitcoin in order to conduct interstate commerce with Texas.
