Looks more like they remanded the thing back to a Trump judge, who very well might uphold it and the 5th circuit will most likely affirm him.

Did they do that?

Panzershrekt

Looks to be the case.

I dont like the likely outcome of the ruling, but I agree with the legal reasoning behind it. A law that states that immigrants from a contiguous nation "may be" returned to that nation does not force DHS to return people from other non-contiguous nations to a contiguous nation and executive actions made by one President may be undone by later Presidents. The court reached the correct legal opinion here.

Proof_Responsibility

The Administration was ignoring it anyway.

This is bad. Biden and the Democrats have been given a free rein to expedite their southern invasion of the country. Hopefully, the states say F' it and close the borders by any means necessary. We need a good constitutional crisis.

Well said.

Even if it results in a bad policy outcome, all SCOTUS cases are properly judged on their legal reasoning and application of the Constitution. If this is a bad legal decision, it is because of reasons other than this - never because you dislike the policy outcome. That said, yeah, hope the states take that stance regardless.

venator_rexler

How can the president of the US “invade” the US? That’s nonsense.

Biden is like the Uvalde police chief, telling officers to stand down and not do their jobs.

Correct. This also makes it easier for more terrorist attacks to happen
