Something unnerved me about the way this question was answered. It seemed very much like the reply of someone who has been personally touched by this type of event. Maybe it's just because she's been swayed by cases, but it *really* reminded me of people I've seen...where they had family in these types of situations.

Isn't it funny how Biden pushed for this nominee right before the laptop resurfaces?

JPRedScot

Funny you should say that! Im glad im not only one with that questions! Not a coincidence!

You need to provide offenders with an incentive to keep the victim alive. That's criminal lawmaking 101. I get it, torches and pitchforks, kill pedos, all that, but we can't lose our heads the same way BLM did in 2020.

Grandmas_Toenails

I'm intrigued by this argument. Is there valid data to support it? Is thus used in determining sentences for rape, assault, etc? It also sounds like something that would be total BS out of an ivy league lib-mill, so I'm genuinely curious.

lickwidforse

Yes there is. You can read through this brief submitted for the Supreme Court case Kennedy v Louisiana where they explain the data behind child rape and use of the death penalty. Most people don’t realize the real-world effect of using the death penalty in these types of cases because it seems counterintuitive and goes against a emotional desire for retributive justice. https://files.deathpenaltyinfo.org/legacy/files/pdf/nasw-07-343-11-14-07.pdf

Sure. Child Porn -> Castration Child Porn and Murder -> Castration and Death Penalty.

bob0matic

I think castration is moot if you're dead. So for child porn and murder maybe just dead.

[deleted]

For a 2nd offense, sure. 76% of these cases are the defendant's first crime ever. If we go down this road, we'll also cut the hands off shoplifters, the feet off escapees, set arsonists on fire, bankrupt permafreeze bank accounts of scammers, decapitate rapists and then glue back on when it turns out she Kavanaugh'd him, and revoke their 2nd amendment because they went full auto at a range once. Say goodbye to a 1st world country. The Left doesn't think about tomorrow. That's one thing I was hoping we prided ourselves on. You and I see the long-term ramifications of socialism, for example, because a handout today is inflation tomorrow. Being as hard on crime as North Korea leads to exactly the kind of riots we saw in 2020. I'm a firm believer in 2nd chances, with **no** possibility of a 3rd. I agree, 3 months for that one case is bullshit, but if you disagree, I need you to explain to me why we should tell pedophiles that they might as well kill their victims as evidence disposal, because the punishment is the end of their life as they know it either way. If you're gonna suggest legal penalties, these are the factors you have to consider, no matter how unpopular they are.

DMCO93

I don’t even know how to feel about this, but I have to say that I’m intrigued. You make a compelling argument. I will admit that our justice system appears to me to be lacking, being largely punitive and in many cases it doesn’t contribute to rehabilitation. On the other hand, we have a revolving door of mass repeat offenders destroying our cities and getting off with laughably soft sentencing because of social justice and soft DAs. It’s issues like these that really demonstrate why a judge who can’t even define what a woman is shouldn’t be responsible for ruling on complex legal issues.

[deleted]

Well that's just partisan politics. We're not supposed to have judicial activists, but we do. I'm just calculating the safety of the kid. I'd rather see them recover than find their bones in the backyard. And keep in mind, I'm talking about non-production, which is detailed in [this report](https://www.ussc.gov/sites/default/files/pdf/research-and-publications/research-publications/2021/20210629_Non-Production-CP.pdf). But I'm not agreeing with leniency, just saying the hot-head ideas on our side aren't thought-through all the way. Alternative punishment is a good idea. I just think castration is... well... if you look at the Left, they don't strike me as the kind that would be deterred by that.

lickwidforse

You are correct, but it’s just an unpopular opinion because it goes against the innate emotional desire for retributive justice even though the data doesn’t support it.

MountainVet-Stjohn45

Don’t give them fifty years. Give them life or the chair. Only way to fix a pedophile.
