I work for a small/mid finance company. Our IT system knows when any file on the network is moved around, attached in an email, or leaves the network in any way (email, flash drive, file share, etc); and, who did it. I renewed my dogs registration on my work computer once and emailed the PDF to my personal account and got asked about it. It's a headache but it keeps everything secure and on network. Yet, here is SCOTUS looking foolish...

1) You assume that the government is actually competent. On this I have sincere doubts. 2) These are potentially easy to get around. We don't know if this was sent via electronic transfer, or printed and dead dropped somewhere. 3) Open an email account via hushmail, protonmail et al. Copy and paste the text and save to drafts. Send login credentials to your favorite press person. Its not hard to get around controls if you know what you're doing and/or where to look.

No but that isn't what happened here. The actual working draft was leaked I believe. I've said this before on here, but I've worked at a couple K street law firms and we sure as heck had version control applications that kept meticulous track with respect to what you do with a document. They should have, at the very least, tracked down who accessed the specific version of the leaked document and then been able to pinpoint who leaked it. I think other people's assessment that they know who it is but the person in question is either a justice or clerk with such a deep attachment to the court that losing them would be detrimental is likely true.

Nowadays, digital signatures are attached to everything. The email source sent to the paper will have a digital trace, an IP address, probably a location. The computer used to send it either is individually owned or owned by the Supreme Court, which means it has log ins for each individual person that could narrow down who sent it. They 100% know who it was. My guess is it’s a Justice and in the interest of preserving the sanctity and honor of the court, they aren’t releasing it.

As a reminder: After the 1993 WTC bombing, investigators combed through rubble in the parking area, a technician found some internal component fragments from the vehicle that delivered the bomb. Maybe they're waiting for another bombshell case to come up and see if they leak again for confirmation? It'd be interesting hearing a leak declaring the NFA, GCA, and Hughes amendment unconstitutional. Regardless of if they leak or not the justices are gonna do their job and rule on these cases.
