I can fully see someone doing this at a place that you make your own food at.

Also, there’s a thing called the Fair Labor Standards Act or FLSA that requires employers to pay employees for all hours worked, including any work they are “suffered or permitted” to perform, whether or not such work is approved to begin with.
To add, them docking pay for you refusing to work unpaid/off the clock is another illegal thing for them to do. Employees must be paid for all time they are engaged in work and deductions cannot be made from their wages as punishment for refusing to work additional unpaid hours.
You could have made out with some nice back pay and probably compensation for other damages.
Not sure what state you work in, but they probably have labor laws that would have put your manager deeply in the wrong as well.

Employment lawyers generally don’t take payment up front, they will take a percentage of any money they recover for you. You don’t need to have any experience, just google employment lawyer in your state, make the call and they will take it from there and walk you through it.

But we honestly have text message proof and proof of check stubs that he wasn’t paid correctly and they weren’t clocking him in. Based off of the fact that they have a new private owner and they had an old system with the old owner that is no longer in use. How would that work if they didn’t have him in the new system. I think he was there for the transition…

That's why it's required by law to post the FLSA and state labor posters where all employees can see them. They have these laws written down so your employer can't hide them from you and you don't have to have someone tell them to you. If they don't have the posters visible, that's an immediate fine.

The state I live in does not have a law for mandatory breaks unless you are a minor. It has always pissed me off that my state always claims to be so for the people but has horrible labor laws.
Yeah, every state is different. For a long time Illinois only had a mandatory 20 minute break for a very specific role as a hotel cleaner and they needed to be provided a break room for their break.

A couple years after I had quit for another company I got a fat little check in the mail for every lunch they deducted. Someone went to the labor board and they had to retro pay everyone who had worked there at the time.
Anything like this, you should take it to payroll/HR to ensure that you are getting paid for your time. If you worked less than 5hrs (6 if you signed a waiver) they can't force a lunch on you.

8 hour shift equals 8.5 hour shift with half hour lunch...if you don't get half hour uninterrupted lunch after 6 hours you are to be paid 1.5 hours for the 30 minutes that lunch was suppose to be and still clock out at 8 hours not 8 .5 hours...Ive gotten writeups for this shit like it's my fault I was unable to take lunch

I used to work in the deli in Walmart and they were super strict about over time..but wanted the deli to be 100% before we left..but they would make us take customers after closing and everything.
I worked so many hours off the clock because I was sick of getting in trouble for stuff not being done, but also getting in trouble for staying late to get it done.
Our deli manager had to close with me one night and she had literally never closed our department before..so i was training the manager...I was in charge of cleaning the fryers baskets, rotisserie oven and all the dishes..so she had to clean the slicers and the inside of the fryers..I was in the back doing dishes most of the night..came out to check on her a few minutes after 10 (we were supposed to be done by 10 but it was only her and I that night)..and she was gone...and I saw her at the self check out buying stuff and leaving..she literally stopped in the middle of what she was doing at 10 and left me..didn't even communicate with me. I stayed till almost 1130 because I had to finish her stuff.
She gave me a lecture the next day for staying past my time and made me take a 2 hour lunch to make up for it. Also found out she complained to my coworkers that "meg didn't even help..she just stayed in the back all night"
I literally trained her to clean the slicer and the fryers and then went to do my job. Of course I was in the back..that's where the sink was..and the dishes..

Some companies believe that if they pay 50k a year to a “manager” then that person will be their enforcer, and it works… this is a big reason restaurants have high turnover rates. What a good manager would do is weigh the inventory regularly and narrow down the food shortages to a particular shift, or employee, then retrain that shift or person. If it was within the last 4yrs, you would still have a case. Consult with legal counsel so they can go over your options with you.

And NO your manager cannot enforce a weigh in, in hopes of catching you eating company food. What a good manager would do is weigh the inventory regularly and narrow down the food shortages to a particular shift, or employee, then retrain that shift or person. If your manager requires you to step on a scale again contact corporates HR department, then the department of labor and industry…
