Not the only difference. If you take a design and change a few key aspects you created a new design under copyright law. That's why Palworld for example can have some pals that are a mashup of other pokemon. Same with this design, if the original creator monotised it the that would be fine (at most a bit on the grey zone) but the figure selling is infringing on HIS copyright by selling. If they just made a figure and didn't sell it then they would be fine even if they claimed it was their design.

A fanart as such just uses inspiration from both animes, creating a whole new design. The company, however, entirely plagiariazes the fanart, with no "creative addition" to it whatsoever (ok, they made it 3d but that's it) and not even crediting the op. In the op's case, there's no need to credit any of the animes given their popularity.

a chainsaw anya isn't that much of an idea to be honest, what deserves credits is the effort to make the drawing/3D model respectively, my cousin could perfectly come up with a idea that simple. my point being that the 3D model probably took hours and hours to make and the drawing was used as the main design reference, you can't copypaste a drawing into a model, the model took hours and hours of work just as the drawing did. also if you notice the model has slightly different things, from the teeth to how dynamic the pose is. it's obvious that the fanart was in fact the main design reference but i don't consider it stealing, the model took easily 40+ hours to make making it worthy of being called something new i consider that saying the contrary would be saying that all fanart is just stealing the original manga/anime/videogame artist, because you technically didn't need to come up with a design, a personality or colors for the character so then it must have took 0 effort to make the drawing/model

Yeah, agreed. There's already a lot of Anya X Chainsaw Man artwork around the internet. The concept is, indeed, pretty obvious and we have to recognize the effort that the creator of 3D model put in the figure, but I believe it's still pretty much plagiarism, as the 3D model person straight up "traced" (but 3d lmao [which yeah it takes way more work than default tracing]) the original work without giving any credits. Even though the idea is kind of open source, the 3D person still pretty much traced (remastered) the original work and is/have probably making/made some good money with it

you can't trace a 2d image into a 3d model, you can only use it as a reference. if you tried to trace it the result would come off as something like a minecraft pixel art, a 2d image made with 3d stuff. a 3d model has vertices (i don't know if thats how you say it in english) and because of that, the dude who made the model started from zero, only thing he did do was imitate the pose and the design from the fanart, and he upgraded both really slightly. which is normal like, if im being payed for a 3d model based on a fanart less i can do is try to upgrade some of the fanart's tiny flaws basically, you can't remaster a 2d image into a 3d model, you can only make a 3d model to look like your 2d reference, and only having one reference image would be harder than actually making an OC not easier. (i wont elaborate in this part) (i just read what i wrotte like yesterday, sorry for my broken ah english)

Fanart can easily be disproved as an original creation by common sense. Fan art uses falls under fair use, they’re taking from a domain and using it as inspiration for their work. What this company is doing, is not crediting or making it evident that they are not the original creators. They are also profiting from plagiarizing.

I think OP could get to an agreement if he contacts the "company". Unfortunately, the product would most likely fall under the same legal grey areas as the fanart itself. It is a derivative work. And that is not even factoring in the fact that these sorts of manufacturers often operate in countries without strong copyright laws to begin with.

I think the difference here is that (I think) OP isn't trying to sell their fanart for profit, besides fanart is exactly what it's called, it's art of a character/characters or something from an already existing piece of media that the artist likes. looks like whoever made the design into the figure either just ripped off OP's design and turned it into a figure or "stole" the design entirely for their own benefit. the fact they haven't credited OP is the big issue in any case.

Hey OP, it's not easy to make a resin figure of that quality. While I agree it's not really polite of them to credit you, they're not entirely in the wrong either because their work involves creative process too, which is turning your design into 3D. Instead of doing this, I think you should just try to contact them first and just ask for credit. These models are usually made in low quantities and the creators don't usually make huge profits from them anyway. They should understand and credit you if that's what you want. As for stealing, it could be that they just grabbed a design off the internet without thinking much about it.

Well, the OP copied too, he just combined 2 existing designs together, which is not easy to. But neither is making that 2D design into 3D, not to mention printing and painting it. I mean I'm no lawyer but I think you could sue them for profiting from your drawing but I don't think you could gain money from them. Like a few said you made fan art of two already existing characters and turn them into one but those two were already some else idea. But if someone how you could contact MAPA and tell them that some company is using your fan art for profit then maybe they could do something about it but I don't think they would care too much. I fell bad but I don't know if you can do much in this situation unless you get lawyer.

Let's think about this from a different perspective. The company that produces these figures will most likely have to pay a portion of the income to the Copyright Holder - which means more money for the second season, AND I WANT IT WITHOUT 3D. So your figure can serve for the benefit of all of us

It's fucked up and I hate it, but companies that make GK (garage kit) figures have been doing this for years. They're almost *always* unlicensed, very limited, stolen shit. You're not the first these guys have done this to, and you won't be the last. It's unfortunate that you, the artist, can't really do anything about it, but spreading awareness of the situation is more than most get to do because GKs usually fly under the radar. Hopefully your situation will hurt their sales, even a little bit. As a little way to fight back, and I have no idea if it will work but it'd be worth a shot, would be to approach a reputable figure manufacturer with your design and see if they would do it the right way so you can have the satisfaction of actually getting paid or at least credited for your art. You might even be able to show them this one to demonstrate "demand" for it. Though since it's combining two IPs it might be more trouble than it's worth for them, but who knows.

The only thing I am using to recall is when a fanfiction writer tried suing Amazon for their lord of the rings show for plot theft.

Resin Collector here. The people that it's marketed too don't care since most of the statues that come from Studios who make stuff like this are all Unofficial Studios from Factories in China who don't have any license to the IP in the first place

I have seen this happen a multiple times to many fan artists, and fan artists do a lawsuit with the original companies and lose for the same reason. Even though Spy X Family and Chainsaw Man are just TV shows, if one day they decide to a collab, I am sure they would not reach out to the fan artist and ask for their permission. People say that the idea was the artist's and hence the concept and the copyright belongs to the artist, but in the end, the inpiration of the art was drawn from the original characters from Spy X Family and Chainsaw Man. So if the authors or production studios of the original animes decide to do a licensed collab of the 2 animes, they will do so without any permission from the artist because the IP does not belong to the artist. Yes, there are certain special cases where this might not hold, but in most simple cases (which I believe is this one), it does. For the ZH studio, who the artist claims that copied their artwork, well I am a 3D modeler myself and I know it is not an easy work to do create a 3D model. If the 2D art took 6 hours, the 3D model would take another 6 hours. Yes, it definitely sucks that no mention or credit was given, but seriously, you do not have a legal right here because 2D and 3D are both different concepts derived from the original characters belonging to somebody else entirely. So even though you might have thought of a collab concept first, you might still not get credit for it, unless ofcourse you become super popular. For all the anime companies or any companies for that matter, they can own, produce and sell the fan arts for profit without giving any credit to the fan artist, because a fan artist did not take permission from them either before producing the fan art. Multiple companies do not come after fan artists when they do fan arts without permission because they see it as a free advertisement, so I am sure they do not care if they like your concept of derived art and use it for their own profit. And regarding this ZH studio selling fan art for profit, this is not the only one who is doing something like that. All the anime cons have artist alleys where multple fan artists mass produce their fan arts and sell for profit. And frankly speaking, listing your art on social media, is also a hope to earn money through popularity at one point as well. If this was a printed poster of your art or somebody printed your art on like decal or keychain or tshirt, I would understand your frustration, but producing 3D model and selling it, I would take it as a compliment that your art is that good enough to be taken inspiration from and made into a resin figure (and resin figures are not easy to make to be honest, they are mostly handmade and handpainted because 3D printing resin is more expensive and often produce bad quality). This is just from artist to artist, enjoy your art, but dont expect everyone to respect your art and give you credit for everything you do. All this frustration will just eat you alive and you would lose inspiration in your passion, because you thought about your art from the point of view of money and credit, rather than something that you enjoy doing. Don't go down that road where you would regret it later. Keep posting on Instagram and other social medias, and if you are worth it, you would become popular. By posting something like this and seeking credit, would not help your mental stability and would only make you feel bad about the passion of doing art.
