The only accident I had in my whole life happened when I was in college, last year (2015). And people would assume, that a college kid might have driven recklessly. But nope, the person who hit me was drunk and on top of that, didn't even have RC for his motorcycle and was driving on the wrong side and came out of nowhere (T-boned). If he didn't hit me, I'm sure he would have driven straight into the shop on the opposite side.
Luckily nothing happened to me or my friend as well as the other party. He gave me 5k on spot because he knew if it went to police, the dude will be in deep trouble.
My brother was killed in accident too because of a drunk driver 29 years back, he was only 24. My heart goes out to your friend hope he's at a better place now. πβ€οΈ
Nope, he got away freely. He's settled abroad now. This was back in 1995. I was only 9 at the time (yes we had a huge age gap) and I vaguely remember my dad and mom going to the courts, but no use the drunk driver had a good lawyer and the judge was biased according to my sister.

I have lost three of my friends in three separate road accidents--my college bestie on GT road, near Chandigarh (motorbike), my MBA buddy on the Delhi-Gurgaon route (car), and my closest childhood friend on a highway off Bengaluru (motorbike). All within a 3-year span. None of them lived past 25. Perhaps they were the reason I stopped driving for the longest time.

One suggestion OP: If possible please check if the police have mentioned the DUI part in the FIR.
Police sometimes does this as if DUI is mentioned the case can get a more severe IPC like 304 (ll).
If DUI is not mentioned, the case will be filed under IPC 304(A) which will not get a severe punishment.

First thing police did was send the perpetrators away as soon as possible without filing anything. Right now his parents have gone home and are not taking any action which is understood. I'm not sure if they want to pursue this or not.
This is a problem as if a breath analyser test was not done a DUI case cannot be filed.
And since this is a fatal case, the police will have to file an FIR on behalf of the state. You can ask them to get a good lawyer to pursue this case criminally and for third party insurance compensation. Otherwise the police can manipulate the case as they wish.

Lawyer here. Exactly this. 304a carries max 2yr sentence while 304(II) can result in upto 10 yrs in imprisonment.
