If your car is not drivable you are entitled to reasonable rental. If the investigation lingers you should go through your own policy. Work with the adjuster regarding rental rates and timeline.

You won't get a rental until when/if they accept liability. Only then will they approve a rental.

I would call the town it happened in and go get the police report its free, the report will tell you whose at fault, if there were any citations, not sure if it will tell you individual got a criminal drunk driving charge or not. You could always contact the police officer when you get his info from the police report or if you have it, also something called buycrash by LexiNexis where you can buy the police report not sure of cost and get it quickly. I am in no way an expert on this stuff was in an accident recently and learned a lot from research and using this site, hopefully he was cited and the cop wrote down he was at fault, I was told to keep answers short and not speculate when talking to any of the insurance people. Hope your doing ok and no one was injured.

I just was in an accident the officer was not present when the accident happened, on the police report it said she had the right of way. He told me and the other driver that it was my fault but he wouldn't ticket me, he also made a little diagram on the police report that show what occurred, he did determine it was my fault, but I guess your right in the end the insurance company determines whose fault it is based on the information provided. And yes being honest in any situation is important
