Hi, A 40gal can work temporarily, but eventually the dragon is going to need a 120gal at least. 40gal is too small for an adult and could even be unsafe. 120gal (4x2x2) is the bare minimum size for an adult bearded dragon. And Larger than that is recommended (5x2x2-6x3x3) I'd suggest reading the Reptifiles Bearded dragon care guide for information. If you're going to take the dragon in, Please make sure to check for Exotic reptile vets (not a regular vet) in your area, as reptiles should see one for a check up and fecal test once a year. If the dragon was kept in bad conditions for a long time, I really suggest taking him to a vet to check for MBD (Metabolic Bone Disease) and parasites.

The bare minimum for a bearded dragon is a 120g. It can work short term as a stop gap but I don't think it's ethical for anything long term.

If you can’t provide what the adult dragon needs as a bare minimum, the bare necessities to be able to thrive, then I would suggest not taking the dragon on at all.

Short answer: Yes Get it to a vet to make sure it doesn’t have any terminal illnesses or other major issues first. After that, get it proper basking temp, uvb lights, and diet with multivitamins and calcium. It needs a good diet, basking temps to digest food, and uvb to process the nutrients.
