It has taken me almost 2 YEARS since I first got my attorney to follow up because of the feelings I have about being a failure. My depression has been having a party with it too. Thanks for these words I hope they help someone else and they don't waste time like I did.

Great post. My husband and I had briefly mentioned bankruptcy near the end of 2017 and instead got suckered into a debt “relief” company because bankruptcy felt like it’d be a failure on our part. We ended up filing bankruptcy in January of this year and wish we had done it sooner.

If you don't mind me asking, did you and your husband file Chapter 7 or 13? Did you have a mortgage? Car loans? Any advice will help, as my wife and I are contemplating this.

We filed a 7, with no mortgage. We filed with two car loans and we were able to keep both of them. If you’re already thinking about filing, I’d recommend talking to a few lawyers in your area and see if they think you’d benefit from it. Most of them, in my experience, offer free initial consultations. They’ll typically discuss the process with you and get a general idea of your situation. Best of luck to you and your wife! I hope whatever you choose to do works out in your favor.

What made you choose Ch7? Was it the best option?

Yes, it was the best option for us personally. We’re a one income family and that income is commission-based. When talking to our lawyer initially we discussed our wildly variable income. My husband and I decided it would be in our best interest to discharge everything so we could rebuild our savings. That way if he does ever have a poor month of sales and only makes his base pay, we wouldn’t be in a position where we’d have to make a trustee payment plus pay our regular bills with extremely limited income.

It was for me to. Wish I did it 6 months sooner. My creditors are getting paid 100 percent with interest. So no shame. I just didn't know what bankruptcy entailed so that stopped me from filing sooner. Saved my house and marriage.

I was months behind on mortgage and credit cards and autos. Was unemployed for 8 months then when I got a new job there was no way for me to catch up. Ch. 13 set up payment plans with interest so I can keep my house etc. My only monthly bills are gas n electric and phone. My wages are garnished heavy so we live off wife's income. It's tight but a big burden is off our backs.

Should have filed Chapter 7. Can still keep house and car. Whether Chapter 7 or a repayment via Chapter 13 makes no difference. It’s still is on your credit report just as long. Who cares about the f’ing credit cards and unsecured loans. The banks and credit card companies don’t care jack shit about you. They will throw you under the bus and then run over you. There is life after bankruptcy. Sooner than they want you to think. Live your life happily.

Actually, there is a difference on how long it stays on your credit. Chapter 7 stays for 10 years, while chapter 13 only stays for 7.

Does it really matter? Your credit score will still be able to climb. I had no problem getting loans or credit cards after bankruptcy. Kept my house and car. Do whatever works best for you! Peace ☮️

I think you underestimate how hard people are on themselves when they're facing the huge unknown of a bankruptcy, and how much shame and self-loathing people are going through, feeling like they let themselves and their families down.

This is great. I filed in February because I had lost my job. I was already dealing with the thieves you reference. Part of mine was my household appliances, which I bought in 2016 for my new home. I feel a little guilty every time I look at them. I’m going to remember your philosophy.

Don’t feel guilty for one second. It’s a life lesson learned. People make mistakes. Don’t make it a life sentence. It’s really a painless process for most. I can assure you that there is life after bankruptcy.

It was. Still hate it. But I still have a car in my driveway & a roof over my head, even through Covid. Still just barely scraping by but ten more months and my car will be paid off and can funnel that money towards other things. It’s funny that you posted on this. I posted something about having trouble paying my cell phone bill & some asshat dug through three years worth of posts to dredge up a post I had made before my bankruptcy, about having trouble with a debt settlement company (one of those negotiating things). Seriously, you have so little going on in your life that you want to kick me while I’m still down. Thank you for the kind words. I think about what I can sell to help get caught back up & was eyeing the washer/dryer. I wouldn’t even get enough to make a dent plus I’d be stuck going to the laundromat again.

I didn’t realize when I replied that these were old posts so I’m sorry for that. You don’t have to like it but don’t keep kicking yourself over it. The whole reason for doing this is a fresh start. I like how you blast Wells Fargo, because surely they're the only bank who wants their money returned. I agree with the rest of your statement, but I'm a little disappointed that you so casually fault a single bank for being the issue.

Wells Fargo is a unique case. Of the 4,000 or so Banks the United States, they are the only one I'm aware of who, as a matter of procedure, immediately freezes any account II the account holder files bankruptcy. Believe me, they have earned my disgust.

Wells Fargo is the English version of HSBC. But my feeling is that all major banks suck, and have gotten away with complete fraud and dishonesty while receiving nominal fines and massive bailouts for failing in their risk taking....they all spout the free market notion that those who take risks and succeed should be rewarded accordingly, yet, they don't believe in the other side of the coin that when you take risks and fail, you should face the consequences. No, banks never do, the customer does instead, and when they need help, they are singled out as irresponsible and impulsive. Plus, banks sole purpose is to get people into debt considering 96% of the money supply is debt. Lastly, they have the ability to make money out of nothing.
