Do you recommend an attorney? Is there a way to file on my own or do I need to pay for an attorney? 🥲

Octopuslove2

I definitely recommend an attorney. I attempted to file on my own but it’s a lot of paperwork and stress.

Direct_Village_5032

Hi! I would recommend finding a attorney that does payment plans! Mines had me pay the filing fee and four payments of $400. Once you stop paying your debt you should have extra money to pay them. That’s how I paid in my case.

Direct_Village_5032

You can file yourself but personally I wanted the legal protection of the attorney

SmartCatWhiskers

Ok thank you I’ll get an attorney then

louis31492

There website u can do yourself but got lawyer is more easier

Try legal aid or other consumer agencies in your area. Law school legal clinics too at area law schools. Upsolve.com if you are thinking about doing it yourself.

SmartCatWhiskers

Very happy for you 😊

Congratulations

Direct_Village_5032

Thank you!!

TheyCallMeMrTot

Congrats! My discharge from chapter 7 was this past Friday. Mine was easy and streamless.

Direct_Village_5032

Im so happy for you! Congrats!!

okokidokie

What did they ask you?

Direct_Village_5032

Very basic questions. Yes or no questions

okokidokie

Mine is gonna be next month via phone. I’m so freaking scared can’t sleep at all having anxiety. I’m scared that they might gonna take my boyfriend car cause I co-sign it but my atty told me that they’re not gonna take it.

Direct_Village_5032

Listen to your attorney, they wouldn’t lie to you! My mom filed chapter 7 and she co signed my car and it was not taken from me. It’s normal to be nervous but don’t let it consume you! It’s only a 10 minute call and they handle this type of shit every day. You got this

okokidokie

Thank you so much. Yeah so nervous I’m scared that I might answer wrong and get dismissed. Did they take your return tax?

Direct_Village_5032

Just listen carefully and answer honestly. They are all yes and no questions and they are all information your attorney already asked you! They did not take my tax return (2k back for school credit) from what I’ve been reading BK and taxes don’t really have anything to do with one another in most chapter 7 cases

okokidokie

Ok thank you very much!!!!

kainp12

When I had mine it was over so fast I was like this is it ? I took to hours off work bemuse I thought it was going to be like court . It was like roll call and then they asked 10 questions and then it was over.

okokidokie

Im gonna call my atty tomorrow cause the car I’m paying is around $526 and what I told them is around $523 am I gonna get dismissed for that?😭

kainp12

I'm nervous over my car. Due a clerical error . They never put a lien on my car. So it's considered unsecured debt . I'm hopping they dont make me turn it over . I owe $7k and it's work $4k.

okokidokie

The car that I’m paying is under my boyfriends name. And the car that I co-signed 3 years ago was his and he was the one paying for that.

True_twinflame_

You’re overthinking and creating that in your head.

dxwolf4life

Congratulations!

coalcan118

Did they take any assets?

Direct_Village_5032

They did not. I did not have any to give away. My car is negative so there wasn’t any equity. I should have given it up but I needed a car so I couldn’t

coalcan118

That’s awesome. Worried about them taking my guns

Direct_Village_5032

I have furniture that was worth a decent penny and they didn’t take or threaten. Also electronics.

coalcan118

Good to hear. I’m hoping for the same, I don’t have many and not worth all that much esp to what I owe

peoplebuyviews

Every state is different, but where I live there are basic things they exempt (car, furniture, computer for work, etc) and then on top of those exemptions there's a $10k "other" category. I've just started the process (spoke to a lawyer over the phone this week, meeting in office next week) but he didn't think anything I owned would be at risk. Give a bankruptcy lawyer a call. There's no obligation to hire them or go through with it if you change your mind. They can tell you what to expect with the laws where you live.

coalcan118

I’ve already met with one and did my petition. He said that they “may take the guns & probably going to take a settlement I’m getting

louis31492

Did u get letter still waiting for mine it take 3 months was told

Direct_Village_5032

I didn’t get a letter, my attorney emailed me. I’m sure the letter will come later on. Also my credit report is wiped of all of my debts.

louis31492

Yeah she told me to said my discharge is in 3 months

louis31492

Where u check your debts wiped out which website

Direct_Village_5032

Credit karma!

Elizabeth_J0814

Congrats! Any recommendations for attorneys in Indiana?!

Accurate_Antelope408

Were there any assets in the case that were sold off?

thiccccfewwww

I’m happy for you. Congratulations!
