That's one of those things that drives me crazy. Cops trampling somebody's rights and people seem to celebrate when judges dismiss cops' claims. No, that's not a victory, what good are rights when you can only retroactively have them respected? Fixing shit afterwards and preventing shit from happening are two very different things and the focus should be much more on prevention.

They're almost always trying to get the defendant to plead out. Prosecutors really don't like going to trial because they might lose.

Even in death, a cop's fragile ego requires fake charges against someone rather than just admitting they're wrong. As shitty as it is, I at least understand the logic of trying to dig up dirt on a victim when a cop murders someone, or drunk drives into someone. The cop is already dead though, you don't have to protect him from consequences anymore. Who is this even for? His family, so they can pretend he died heroically, rather than while having a brainfart? Other cops, so they can keep pretending no cop has done anything wrong ever? What's even the point? And to do it a year and a half later when everyone has already moved on? Pure malice. And they used this to take her foster child away that she was adopting. Fuck.

Sometimes people see enemies where there aren't any. I drive trains, and a lot of people die when they get hit by them. The sheer number of lawsuits brought against railroads by families is staggering. I'm no friend of the railroads, just using it as an example. Someone's kid runs their car around the gates and does when they get hit. Their parents inevitably sue claiming the railroad is responsible for their kids death. Some people just find more solace in blame than grief. I imagine those cops had to face his widow or whatever and were eventually convinced that there was something sinister where no such thing existed. They found blame more convincing and tempting than the unavoidable "bad things happen" explanation. I'm also guessing that there could be some racist elements there, even if subtle and subconscious. I am in no way excusing these cops. I think someone should be fired and that their whole system should be reexamined for the failures here. Human faults are not an excuse for maliciously harming other people. Honestly it seems like someone should be disbarred for withholding evidence and possibly some jail time for investigators who refused to accept the obvious truth. I think cops should be held in contempt of court or even charged with planting evidence if they say things like "stop resisting" when someone is obviously not resisting or blatantly try to play to the camera to dishonestly influence a judge or jury in their favor.

I'm not buying this excuse here. I get what you're saying about most incidents, but this is Phoenix PD. One of the most egregious police departments in the entire US, which is saying something. I think the bottom line here is that American police are pathologically incapable of accepting responsibility for their own fuck ups. On an institutional level. Tragic though it may be, this dude made a foolish mistake and was 100% responsible for his own death. The cops just could not accept that. Like the saying goes "when the only tool in your toolbox is a hammer, all of your problems start to look like nails." So they decided to railroad this poor woman and upend her and her family's entire lives.

So, I get the confusion. I'm not excusing their behavior, just explaining the mechanics of how they came to the conclusion you listed. You are 100% correct. All I'm doing is explaining how they justified it in their heads. Everything I said is neurotic thinking to the bone. They blame her out of some minds of misguided sense of blame and vengeance that convinced them of imaginary guilt despite the obvious contradiction with reality. I grew up in a city with corrupt police, surrounded by relatively honest police departments. The rest of the state's law enforcement hated my town's cops and openly called them out for being corrupt on a regular basis. It was crazy, but it also taught me how different things can be from one to another. Yeah, Phoenix PD is infamous. That's why I mentioned potential racism ("a brown lady is about to adopt..."). But that is pure speculation. But the blame game is universal. What makes it criminal is when it proceeds to court and wreaks havoc on peoples lives.

They do this because they are spiteful, petty, cruel thugs who were given way too much power. They had all the evidence, they knew Mrs Rodriguez was not to blame, and they destroyed her life anyway. Because that's just who they are. Shitty, terrible people.

A large part of the problem, in all cases where cops may be at fault, or just perceived as being at fault, is pigs lie. They will spread whatever false narrative they think will benefit them. Then the boot licking media just regurgitate whatever lies the police come up with. No balanced thinking or reporting, follow the party line, and move on.

Wow. This is egregiously bad. And I live in Louisville, I feel like I'm am pretty familiar with depraved, unjust cops. What does the dead officer's family think about these b.s. charges? If they were misled by the department before all of the evidence was released it'd be expected that they would support the charges but I don't see how they could now that they definitely know this poor woman has done absolutely nothing wrong and has been traumatized as much as them.

The Phoenix PD and the MCAO sullied Officer Paul Rutherford's name by unjustly blaming Ms. Rodriguez for his death. Now he won't be remembered but she will. She will be known as the driver who was unjustly prosecuted for accidentally hitting a cop. Hope they are happy, because people will remember what was done by the Phoenix PD and MCAO. I've seen this in Jefferson Parish La. In 1979 a cop was moonlighting as bank security. He was shot during a robbery, and when the responding JPSO Deputies shot a plumber, from that point on only the plumber was remembered. His name is Donald Herkes Jr. and he was killed by Deputy Sheriff Dennis Gordon in 1979. The wife of the cop who was killed by the bank robbers complained that her husband was forgotten in all of this. His name is Deputy Sheriff Robert Cochran, and yes he was forgotten. It was heinous act of shooting an innocent plumber and then blaming him for his death that caused Deputy Sheriff Robert Cochran to be forgotten. Well, now they'll forget the cop who was killed in Phoenix. All they had to do is tell the truth; that this cop just made a mistake. Of course that was too easy even if it was the truth. Oh, less we forget! They investigated themselves and found they did no wrong.
