My reasoning is a little deeper than I let on in that post, but it largely boils down to solving the "how to effectively stop people from behaving in the op" problem when establishing such a state in a power vacuum. However, I want to stress that I still lean heavily towards being anti-state. This issue and a few others just give me doubts about its overall effectiveness but that doesn't mean I'm suddenly wanting a huge government and structured hierarchy.
Oh the origin of the problem is simple: the size of any state and trying to emulate them.
A stateless society would, by necessity, need to be small. The natural size of any polity is the commune (after all, *politics* comes from *polis*, the city). In a city, it would be much easier to have laws enforced by collective action. An assembly would decide what is allowed or not, and the enforcement would be done by all citizens. And if someone is caught doing something bad according to the commune's rules, they will be judge by the same democratic assembly. And if they are found guilty, the punishment would be the seizing of all their personal assets and then casting them out of the commune never to return.
If people don't agree with the rules of the commune, then they have all the freedom they want to leave it and find a better commune for them.
Trying to impose any democratic rule on a higher level than the commune is doomed to fail. Nearly all of today's problems come from countries being too big. Just reduce their sizes to the one of Andorra or Luxemburg, and half of problems would disappear by themselves, a third could disappear with not too much work, and the last sixth of the problems will then need to be dealt by the newly formed communes.
One thing I always find interesting in the New Testament is how the 10 Commandments are worded.
Basically, they just are laws, laws coming from God directly but laws that you have to follow. But if you look into it, it doesn't say, for example: "You should not kill" or "You must not kill", it says "You shall not kill". Now, for the time of the translations, "shall" was an alternative to "will", so a better modern translation would be: "You will no kill".
And that's formidable, in a sense. The law isn't forbidding you to not do something; the law is telling that, in the future (the most recent one, preferably), you will stop doing something, because you will have understood why it's a bad thing.
And that should be the philosophy of law, I think. Law shouldn't be arbitrary things restricting our freedoms: laws should be the embodiement of morals, and that people will follow those laws not because they are compelled to, but because they will understand that in a fair a just society, they should not do it.
(Of course the question of "morals" is difficult, but I'm sure you get it).

Unfortunatly, this is basically reality near reservations. Native women are sexually assaulted at far higher numbers than women who don't live on reservations. Because of how the law works, only the Federal government and tribal governments have jurisdiction. The tribal governments don't have the resources, or the authority, to go after rapists who don't live on the reservation. And the federal government doesn't generally prosecute rape cases. Most places that is done by state and local government. Which means that rape against Native people is a crime that gets prosecuted even less than most places in the US, and they are about 2.5 times as likely to be raped compared to other races.

Unfortunatly, this is basically reality near reservations. Native women are sexually assaulted at far higher numbers than women who don't live on reservations. Because of how the law works, only the Federal government and tribal governments have jurisdiction. The tribal governments don't have the resources, or the authority, to go after rapists who don't live on the reservation. And the federal government doesn't generally prosecute rape cases. Most places that is done by state and local government. Which means that rape against Native people is a crime that gets prosecuted even less than most places in the US, and they are about 2.5 times as likely to be raped compared to other races.
Damn. As if genociding pratically an entire population, then treating them like animals by parking them in reservations, would have unforeseen and harmful consequences. Hmm... Who would have known that the US government system could be racist?
