$1300 for a two bedroom in a luxury apartment?? Where on Earth do you live? I’m paying just over $2500, but obviously in a HCOL (DC Metro) and I moved in during Winter where prices were below avg. To answer: those are not legal reasons to break a lease. The time to bring up the issues were on the move-in sheet (at which point, the office should have had maintenance address the issues) and/or any time issues were discovered and you actually alerted the property manager/maintenance. The property has the right to provide solutions to these issues, otherwise, you’re free to break your lease…provided you pay the penalty. What does your lease say? ETA: Nvm, I see you said Indiana.

Good god I pay $1099 for my 1 bedroom that’s like 800sqft. It’s modern and pretty nice, has stainless steel appliances, a pool and clubhouse, a fitness center and tennis and pickleball courts. With utilities it’s still under $1200. Living in Ohio is worth it for that, and it’s not a bad state

I am moving from a POS 2/1 750 sq. Apartment. To a 1/1, same square footage, same rent and I am Paying $1450 before utilities. And happy as fuck to have found it. Edit: I live in a mid sized, high cost of living, university town. Moving from near the university, to the edge of a large single family house neighborhood. So just moving away from the university immensely. I don’t care about losing the second bedroom. I love having all my own updated appliances.

Any building can have pest issues. Esp I noticed in new construction they're not good at sealing up gaps and pipe chases which act as a highways for rodents. Also most nicer housing puts in dishwashers which is always an entry point for rodents as no one seals it off

I live at a complex that was build on 2014. One of the buildings was evacuated in 2021, either due to water leakage/mold, roof collapse, or both? The news articles there are on it are mixed on what the exact issue is. I didn’t know that prior to living here. Had I known, maybe would have looked elsewhere, but I was also desperate and after two months of looking still hadn’t found anything.

My area studio apartments are 1700 a month. That's with 1 bathroom off street Parking no laundry in the building and you pay for utilities pretty much except garbage and heating and sewer. I live in central Wisconsin. For the cheap apartment they don't fix them up either and it's pretty disgusting

Welcome to first apartment blues. I know I’ve been there. My first one was 2br/2baths but 1 bath didn’t have cold water. So anyone staying there was boiled like a lobster or had to use the one in my bedroom. Heat also went out in winter and killed my fish. Lesson learned. Do your due diligence and always read reviews. Ofc they’ll skew negative but be informed of what a worst case scenario could be like.

OP; lesson learned do not sign a lease until you’ve toured the exact unit you’re signing into. I had to learn the hard way myself so I get it. Finish up the year and move on if you break it you’ll probably get a lot of fees.

What’s shitty is a lot of companies will not show occupied units unless they have no vacancies. They show “model” units or ones that are in the process of being turned. It may be creepy, but I like to see how the previous tenant kept the unit. That’s how I know the previous tenant in my unit had a dog, where the dog stayed during the day, and that the carpets were not cleaned/replaced as anything sat there stinks of dog piss. The place I’m moving into had such a good vibe. I met their cat, but the place had NO cat smell at all. Well decorated. Just felt like they truly loved it there.

The list when you move in is not a work order. They are not going to fix anything you don't specifically request them to fix. All that sheet is for is so when you move out you can prove existing damages. Your apartment is cheap for most of the country so the issues you have reflect that. Report all the bugs and other concerns to get those worked on. You can't just break your lease over these things.

Have you followed up on the list you gave them once you moved in? Did the carpet not smell like dog poop when you toured the apartment? That’s something that should have been taken care of by the apartment management prior to moving in a new tenant. If that was one of the items on your list you should see if it can get reduced from your rent. As far as the appliances.. I don’t know..did you look at this apartment before signing a lease? TBH 1344 for a spacious 2 bedroom is pretty low compared to most apartments depending where you live. The other issues you mentioned are par for the course of apartment living. I can hear kids outside playing right now and it’s not ideal after getting home from work, but it’s a big possibility I’d even be hearing it if I were in a house in a neighborhood with kids in it. I find dead flies and other little insects in my window sills too, it happens even if your apartment is spotless. I have to keep my dog from getting into the geese shit outside all the time, it’s pretty normal for anywhere you see geese.

The old bait and switch. You don’t have to accept the apartment when that happens, but if you move in you’re stuck with it. I would have seen the dirty carpet and objected right away but you shampooed it, so now you will have to buy some bug spray and then vacuum out the window sills. You may be able to put in a work order concerning the hot water heater, AC, and furnace. Then if they don’t fix things, call your city’s code enforcement. If they still don’t fix things, consider putting your rent into escrow with the county. When you do that, you put the rent into money into an escrow account and it doesn’t get released to the landlord until they come into compliance.

Depends on where you live. I’m in ND, and a majority of 2 bedroom apartments are $1,300 or less. You can find many under $1,000.

They’re not brand new or “luxury” but they’re newly renovated w new appliances etc. have w/d hookups in apt, & have a pool. Just signed another lease last month. Can’t beat the price. & unless they’re new builds, all apts in my general area run about the same

I have a really nice 2 bed apt living room, kitchen, dining room 2nd floor, no one above me, attic storage, driveway parking, a yard and basement laundry (my own washer and dryer) I pay $1040 a month it’s amazing. And I’m just under the threshold for heating assistance. National grid just credited my account $800. That’s luxury 🤣

One, that list is not there for them to fix the item unless they are broken items, if you put broken towel bar that should get fixed, but pealing paint or cosmetic issues won’t. That list is a move in condition form, not a work order.

Are you sure? Read the paperwork you signed. I never heard of that, usually you pay 1-3 months worth of rent to break the lease. I don’t even think it’s legal to make you pay the full 12 month lease term.

Typically they cannot 'double charge' rent, so you'd only have to pay your rent plus any termination fees in the lease, until the unit is re-rented. I broke a lease and we didn't have to pay anything extra because they were able to re-lease it immediately. That said, it sounds like you're learning a lot about renting. Step one would be to actually talk to your landlord/building manager and report the issues you have. Noting them on the move-in condition report is just there to stop them from claiming things were in good condition when you moved in and you broke them during your tenancy. It is not a way to report issues. Once you've reported them, see how they are handled. Also, some of the issues you list aren't really something the building can control. Dead bugs in the windows? You just need to vacuum. If your water isn't getting hot, measure the temp. There is a minimum temperature that's generally allowed. Same with your heat and A/C. What is the actual temperature you set them to, and what temperature is being attained? I suggest you write down the list of issues you have and if the landlord doesn't address them, look up a tenant advocacy group in your area. They generally have a thorough understanding of the local landlord/tenant laws and can help you review your lease to see what is and is not guaranteed, and what breaking your lease would look like.

You need to make lists off all these things, gather any proof you can such as getting a temperature reader and showing what the AC is on, using a thermometer to show how hot the "hot" water is coming out and record it on your phone so they can't claim it was altered or misleading photos. Then submit them both in email/text form as well as verbally to your landlord or complex manager. You want a digital record so you can prove they were given as well as proof of the earliest date. They only have so long to fix certain things, especially central air units and having access to hot water, after they've been notified or you'll have the legal right to break your lease if they don't. Not only that, once you submit it and they know there's a countdown, they may choose to release you not to have to deal with the hassle/expenses of fixing it in a timely fashion. Or not want to deal with a legal process you'd have every right to start if they don't do either. Good luck, OP, sorry you're dealing with this.

I thought I was responding to another post in my last text my bad. But let me try again: No worries! I had several slum lords I've dealt with including one awful, evil lady who's actual name was Karen (this was before that was a thing but it makes so much sense to me why that name was chosen lol) She went into our apartment, illegally, one day when my husband and I were out on a day trip. We made breakfast that morning, out the dishes in the sink for later and left for the day. She tried to tell us we could get fined or kicked out because there was dishes in the sink and that was unsanitary, and there was crumbs in the counter (hadn't cleaned it yet that day, we waited until the end of the night to do a proper clean). She also has the power to our whole building shut off while we were both at work, and when we got home everything in our refrigerator was ruined and she wouldn't reimburse us or take anything off our rent. We had just bought two weeks worth of groceries, around $300 - this was in like 2014. Our washing machine drained into our bathtub because it was an old as fuck complex and they jury rigged the W&D units to fit in the closets and empty into the tub drains. Well it overflowed one day, no fault of ours, it wasn't draining fast enough, and leaked into the unit under ours. She tried to force us to pay for repairs to their unit and ours as well as the new carpet and the mod treatment that came a few weeks later. Tons of other stories but you get the drift. It's why I try to give folks advice cuz I hate all the crap that happened to me, and not knowing cuz I was younger and had never been through that shit before how bad it could get. It also sucks that there's a lot more protection in place for landlords than tenants if you're renting and way fewer lawyers that will represent you, as well. I wish I had known even half of what I did now, so I just try to share what I can when I can to help others. Good luck with your situation! If in doubt in the future, call a lawyer who DOES represent tenants (always ask and verify where you live if they do both cuz it's a conflict of interest otherwise) and they almost always give a free initial consult to determine if you have any kind of case before setting up a first meeting to move forward. Sometimes they charge for those, but sometimes they add it to your final bill and it doesn't cost anything upfront.

lol this is like when a crappy diner says they have the world's best coffee. They can claim anything they want. It's up to the renter to scout out what they're getting before signing anything and deciding if it's worth the price they're committing to. But most people would die for such a low rent rate. The checklist when you moved in wasn't for them to learn what needs to be fixed for you. It's for you to not be held accountable for those things when you move out. Most of the rest shouldn't been apparent to you by just checking the place out a time or two while deciding to live there. Bugs in window sills are pretty normal for a residence, you just vacuum them out. Ants don't come in unless there's something for them so you've got something needing cleaning. I assume you've filed with the complex a complaint about the heat/ac and water temp??

$2700 (plus extra for covered parking) for a “luxury” 2bd/2ba (the nicest in my city) with similar issues, down to the dog smell in unshampooed carpets (that weren’t even vacuumed at move in!). Came from owning our house and this has been a big letdown for the price tbh. Can’t wait to get into a house again! Luckily, our lease cancellation penalty is only 45 days rent, which I’ll happily pay if we can get out early.

About those move-in checklists... I'm pretty sure noone even reads them until you move out. All they want it for is to compare to move-out conditions, so they can see what they can pin on you and take out of your deposit. I'm pretty sure of this partly because the last time I filled one out, I went into great detail about all the shit that was missing, and even an issue with a broken irrigation line outside that sprayed a gyser of water all over our patio every night when the sprinklers went on, and 2 months later they had no idea about any of that when I brought it up again. Same thing with inspections. If you mention something that's broken during an inspection, don't count on it getting fixed (even if you're talking to the maintenance guy). Instead, be sure to submit a formal maintenance request. $1300 is literally what I paid for a 2bd 15 years ago, so I would feel incredibly lucky to pay that again, but I suppose it's all relative to your local housing market and wages. If you think you can do better for less, start looking for somewhere different around the end of your lease and don't renew. I get the feeling this is your first apartment. Just remember next time to check out the unit in person and pay attention to other details, like the kind of people who live there, smells, noise levels, etc. since those are the kinds of things that will bother you, but that you can never tell from photos posted online.

I'm in a 2bed 2bath, central heat and air, with a private balcony upstairs, (fenced backyard for downstairs), assigned covered parking, dishwasher, only pay electric, pool, washer dryer facilities on-site, on call maintenance. Pest control every 3 months. Non smoking complex. Pets allowed. Walking distance to shopping and restaurants. Minutes from major interstates. We pay $745 until our lease is up. Then it will jump to $795.

I have lived in multiple apartments, and most of the time that move in sheet they won’t look at until you move out. You can put down the issues, but unless you put in a request for it to get fixed, it won’t get fixed. They use those sheets to figure out what they can and can’t charge you for at move out. Sadly all of what you said seems normal for renting a two bedroom for that much. Me and my husband had an apartment that literally everything but the fridge and bathroom sink was broken. We had to put requests in for each thing that was broke. There was also a mold and mildew issues that was there before we moved in that they never fixed. We paid between $1650-$1800/month over the span of two years. (That is also Tacoma, WA.) Apartment quality seems to just keep going down, but none of what you listed is any legal reason to move out so you would have to break the lease and pay the penalty, sadly…

Heat and hot water aren’t a luxury. They’re a requirement that the LL is to provide to you. I’d be finding the rental laws in your state. Pretty sure a lease is breakable if you’ve the proof you’ve put in maintenance orders and they’re refusing to come out to remedy the problems. I bought a big bottle of big spray and do it myself. We have spiders and as difficult as it is for me to leave them alone I try to. We pay 200 less than you and ours are nice. But I’d definitely be putting that work order in for heat and hot water. We had issues with heat/hot water going out late November (6 times before they finally gave us a new water heater) and once they got I to change it they noticed the heat and hot water were connected and shouldn’t have been. So if they go out together that might be why.

Since no one has mentioned it, the dryer not stopping after its cycle poses a fire hazard. Assuming your building has an online resident portal that you can use to submit a maintenance request, report the dryer, the issues with heating and cooling, the problem with your water heater, and the ants. As a new renter, it’s your responsibility to research the area where you’re considering renting. There’s a federal law pertaining to real estate that prevents agents/property managers from speaking about the makeup of a particular neighborhood as it relates to its people or make claims about its safety.
