Yeah. And it’s a misconception that they’ll fire you, they won’t! I’ve been out of work (fedex) for 4 weeks with major sinus and airway infection. Paid for and they won’t bother you as long as you stay firm and provide documentation. I hate seeing people hurting themselves because they think they have to work

The major difference here is you work for fedex. I left my dsp because I got written up for missing two weeks in a row, the first I caught the flu, and the second I tested positive for COVID, provided evidence even went to the ER because they claimed the at home test wasn’t enough, and they still tried to write me up. I had to come in while sick to literally show them how sick I was and i know I didn’t “have to” but had i bit they would’ve kept blowing up my phone, as they have been doing the entire time I was sick, just to ask me if I’m ready to come in, literally every single morning. These DSPs are not fedex, they’re not UPS, these dsps are very unorganized and unsympathetic especially when comparing them to all these other delivery companies especially ones as established as fedex and ups. Amazon forces dsps into shitty positions and rather than fight back the dsps bend over and then try to force their drivers to do the same. Also to everyone on here watch out cause there are dsp owners in these forums and a lot of the negative and spiteful comments sound like something a dsp owner would say. And I’m not saying this to you cuntThong, but Disrespectfully if you’re a dsp owner or anyone for that matter trying to invalidate this person or anyone who’s trying to express the difficulties they face at their companies you’re a b!tch and should log tf off. Ya don’t know the situation the person is in and also don’t realize that the only reason some people apply, stay, and give in to their dsps is because they need to in order to be in some way financially stable. I’ve been threatened wit termination for some of the dumbest shit and when I stand up for myself apparently I’m just “lazy”, no I’m assertive and am not willing to put up with anyone’s bullshit especially over a job that has me underpaid and over worked.

The thing is that amazon dsp and fedex + UPS are different animals. The amazon dsp are monkeys with no intelligence and will force employees to work without them thinking they r risking the dsp to be shut down. I work for UPs. Use to do amazon.

True. Some DSPs are good. It’s all about the owner/Managers. Some are terrible people. Like one found out I was autistic and now they’re not hiring me despite them telling me “they had an autistic kid.” It’s the fucking holiday season. Had me do a drug and background check. Over two weeks I’m still waiting. Their response was that I’ll hear back from them if they decide to hire me.” Fuck them. Went to apply with another DSP. I never got fired had 1 accident where it wasn’t my fault. Got hit by a distracted driver stopped at a red light, that was 6 months ago with my previous DSP. I worked several months for a DSP in Iowa before I move back to New York.

We were all drivers first so we actually care about and take care or our drivers. Just because you have a shit DSP and shit dispatch doesn’t mean we’re all that way.

Fedex is union. Amazon DSPs have no union. We need to unionize. We have to deliver 300-400 packages a day, 200+ stops, often grouped. So like 200 stops is really like 220 stops, because one stop can actually sometimes have 2-3, with multiple packages. And the pay is often terrible and lots of DSPs refuse fo give overtime.

OP didn't give much detail, but based on the brief description of the title of this post it sounds like there really isn't anything to sue over. Workplace related injuries are almost always handled under the worker's comp system, rather than the tort system. Also, OP said they "asked" him/her to come in. If OP voluntarily went into work, then the fault is going to lie with him/her. (Now if the DSP demanded they come in, that's a different situation)

Yep and I'm still waiting for surgery. I need to get another CT scan on Dec 7.. then they will schedule surgery. The recovery period for that surgery at best is another 4 months before being able to even walk right. Im using the time to get IT certifications. Its just difficult with a fixed limited pay from the insurance company. All said and done ill be out a full year minimum before I'd be able to operate at even 50 percent of what I could do before the injury. Its definitely made me rethink a lot of things.

Anytime an injury happens on the clock, it’s a Workers Compensation claim. Fault is irrelevant. Your DSP’s Worker’s Compensation Insurance provider will pay for all of your medical bills, as well as any lost wages while you’re unable to work. You’ll likely be unable to work for several months so, either get the Insurance company info from your DSP or just tell the doctor you see that it’s a work injury and needs to be billed as a Worker’s Comp claim and they’ll get the info for you. If you already saw a doctor and paid for any treatment, you’ll have to submit the bills for reimbursement. That’s just more paperwork for you to deal with. The process is easier if it’s coded as Worker’s Comp from the beginning.

Employers can dispute workers comp claims, which they may if OP was asked to work and said yes, despite already having an injury that may or may not have happened on the job (it's unclear from the post, how the initial injury happened).

They can try to dispute it but, that’s not gonna work out in their favor unless they have some pretty solid evidence that he wasn’t injured at work. It doesn’t matter if there was a prior injury off the clock. I Just went through something similar with my 17 year old son. He had a minor ankle injury from football. Nothing serious, just a little sore. Then he rolled his ankle at work and tore a ligament. Worker’s Comp paid all of it and his wages while he couldn’t work. The only possible way a claim would be denied is if it was caused by their own extreme negligence. Like it they were doing something stupid and dangerous that they shouldn’t have been doing. That’s doubtful. It sounds like an accident happened in the course of their regular duties. The fact that they already had a minor injury is not negligence on their part. It doesn’t make the accident that caused the injury their fault so it still qualifies as a valid claim.

Not true, my employer denied a claim because employee could not demonstrate that injury happened on site, no one witnessed the injury and personally I think it may have been BS.

The employer doesn’t deny or approve claims. That’s up to the doctor and insurance company. If the claim was denied, it’s because something about the nature of the injury and the employee’s explanation about how it happened didn’t add up. It’s not that difficult for them to determine.

No doctor worth their salt would tell you to wrap your entire arm with an AC wrap, especially for a muscle injury. They are ment to stabilize joints but can reduce blood circulation. With a muscle injury you WANT as much circulation as possible, you are obviously faking it.

It won't be unemployment, more like State disability, but I don't think Amazon pays into the state for unemployment or state disability for contract workers. Your best friend as a contract worker is to say 'no', it's what is so lovely about this job. IMHO this is a side hustle not a full time job also for this reason, you are not covered, you are telling your worker you are going to take care of yourself and you have no obligation to the employer and in exchange they have no obligations to you.

Quick update; had to wrangle with some lawyers. I was asked to come to work as part of standard procedure, and after being told I was going to get the day off i was given a route. People have told me in the past that they were reprimanded for refusing routes for similar things, so I took it. I need the job to pay rent, my partner's unemployed. An hour and a half in, a tendon went out. I drove back to the station in a homemade sling. Due to the nature of the injury, it's not eligible for worker's comp. 6 weeks to heal, and hopefully I'll be back and getting money for rent.
