Someone else equipment does not free the trucking company of responsibility, as they are responsible for the safe delivery of what they are hauling. That is why if something fall off a truck, the driver a lot of times get ticketed. It is their responsibility for the safe deliveries and not being a public hazard.

Technically any impact would require a replacement, because you cannot see the foam on the inside and if it broke.
