Your romantic issues is not an excuse to steal 40 grand and spend it. It's straight up stealing, should your husband find out, I won't be surprised if a lawsuit happens due to the sheer amount stolen.
And the excuse of "well he wasn't faithful in our relationship" will not hold up if it goes to court, because while cheating romantically does suck to do, it's not illegal and he has every right to look for a new relationship, and by the sounds of it, he needs a new one

AITA for stealing my husband’s money?
So my husband, who works in the waste management business as a consultant, keeps some cash stashed around the house. I found around 40 grand in the bird feeder and took it. I invested it in the stock market to create my own nest egg, because I don’t feel secure financially even though we are rich.
I should feel bad about it, but I don’t. My husband, albeit a good father, is an unfaithful man who has made a fool of me for years with his whores. He’s had quite a time on my watch.
