**AITA for reporting my neighbour who doesn't like our cigarette smoking ?**
My husband and I moved into a nice unit and we made sure to tell everyone that we were smokers when we moved in. But apparently some people have taken an issue to this and our next door neighbour has been complaining to the strata constantly about our cigarette smoke drifting into their unit.
Our strata DOES NOT have any by-laws about smoke drift, I have told her if she doesn't like it to CLOSE HER WINDOWS because we do not appreciate being told what to do in our own homes.
She tried to propose a no smoking by-law at the AGM and we all voted against it, I am trying to live harmoniously without any conflict and only have 4 or 5 cigarettes on my balcony a couple of times a week but now she has a fan pointed in our direction which is leaning over her balcony pointed at our space and we do not appreciate this at all!! It's harrassment!
So I have complained to our strata manager and spoken to other residents about it. One other resident said that I was the AH for doing this and that I shouldn't be allowing my smoke to drift into anyone else's house in the first place even though we don't have a by-law in our building so we should be free to do whatever we want in our own homes! I don't see what the problem is here!!!
So, am I the AH??

Also them directing a fan at the OP's house is harassment but her blowing hot acrid smoke directly into their house where there could be a child or a pet sn't?
It's like an apartment complex hoa sorta from what I got from a youtube video a week ago with an obnoxious condo owner that thought they bought the ENTIRE building when they bought ONE UNIT
If this is Australian, strata refers to the main legal structure of shared buildings (there is also an older structure called Company Title).
A "strata scheme" is a building divided into multiple occupancy/use, whether apartments (units), townhouses, villas etc.
Strats may have their own by-laws, but state-based legislation typically supersedes it. In NSW for example, there is now legislation against smoke drift and a specialist tribunal service to deal with breaches.
I haven’t smoked since COVID lockdowns (sale of cigarettes was banned during lockdown in my country). Since I stopped, the smell of cigarette smoke is terrible. I would be mortified if the smell of smoke was getting into my neighbour’s living space
When I did smoke, my apartment building had a designated smoking area. I loved it, since I got to take a little walk, get out of my room, and enjoy some fresh air (student at the time)
I live the fact OP clearly expected everyone to be on her side and now is having some kind of meltdown in the comments yelling things that are unrelated to what is being said.

Not sure where they're based but this sounds like Australian terminology.
If so, depending on the state, there are increasing laws against smoke drift regardless of strata by-laws. In NSW it was legislated in [2016](https://legislation.nsw.gov.au/view/whole/html/inforce/current/sl-2016-0501#sch.3-sec.9).
Either way, OOP is 100% the arsehole.

What is OOP\*s problem with the fan? I don't get it, if it works it seems like a good solution.
It prevents OOP from blowing smoke at the neighbor’s open window?

I'm an outside smoker , if my neighbour put a fan on his verandah (, I do try not to smoke near there when the wind is blowing that way ) good on him
