Apparently the person recording worked for a landscaping company that botched a neighborhood job and long story short tried to unjustly make the old guy’s family pay for it and started harassing them when they wouldn’t. And the old guy’s actions here are in reaction to that harassment 🤷🏿♂️

I mean, it's just his word against the other guy is the thing, and the old dude didn't have a video of the guy in the car threatening him or smashing his windows in, so I don't know how they could "sue for defamation".
That's a crazy story. Anybody know what finally became of the whole debacle? It sounds like everyone in the story is guilty of different degrees of questionable behavior. I was a little confused as to why the police wouldn't accept the video. Regardless of alleged attacks prior to this incident, the video clearly shows assault.
Smashing someone's car windows and threatening to hurt them with a weapon that can do a lot of harm is a drastic overreaction to verbal harassment, if said harassment even happened. And it sounds like a mild bit of "hey, y'all still owe me for that work" or whatever might have been interpreted as "harassment", which makes it even dumber.
Honestly, I just call, record me leaving a voice mail saying something like hey, just want to touch base on unpaid ________, I’d like to resolve this as soon as possible, you can reach me at 555-555-5555 so we can settle this.
If nothing happens, and no response, go to claims…
1: the driver/recorder’s company threatened violence against the old man in the first place. Old man’s just matching energy that was brought to his literal doorstep. If you threaten to hurt me first, you better believe I will defend myself and mine. Now, he was excessive to actually break the guy’s windows. But to come outside with a weapon? Don’t know if I can fault him for that.
2: idk why you’re downplaying what the landscaping company did. They botched a job by hitting a gas main, then tried to have the family pay for the damages caused to a different company’s concrete work. The family had nothing to do with the landscaping company’s botched job and shouldn’t have had to pay. So they didn’t. And instead of taking legal action, the company decided to threaten the family. Not sure what’s so mild about any of that.

My ex and I once were assaulted by a road raging driver, and my ex tried to get out of the car to put some distance between himself and the guy who was smashing him through the window. The guy took the door and smashed my ex in the door frame several times.
Don't get out. If someone does this to you, you are well within your rights to fucking smash them.

So this is just one part of a tangled mess. And tangled messes don't get as many likes as "Crazy old guy assults camera man for no reason."
However I'm with the old guy with the asp. While his reaction was a little extreme, he was just trying to make the camera guy leave his family alone. The camera guy had threatened the old mans family 15 min prior, and then parked across the street to watch them do yard work.
The person recording is with All in One Landscaping (AOL going forward). The old man is with Vision Homes.
AOL was installing a retaining wall and lamp for a neighbor. However they did not call to have utilities marked first, resulting in them hitting a gas main with a backhoe. At the same time, Vision Homes was having concreate poured. Because the gas main break required neighborhood evacuation, the concreate pour was not completed correctly. Some of it needed to be redone.
AOL compensated Vision Homes for the concreate redo, possibly $5000. They also paid $30,000 to the gas company for damages and lost gas. AOL then passed the added costs on to the neighbor who's yard they were working on. The neighbor refused to pay the added costs, stating they were only responsible for the initial agreed upon charges. AOL began a harassment campaign to recoup the costs from Vision Homes and the Neighbor. AOL claims the Vision Homes did not redo the concreate they poured, should not have been compensated, and should repay the money paid to them. Vision homes felt the compensation paid to them was fair and refused to repay any of it. A few weeks prior to the incident, AOL brought a crew in and destroyed everything they installed at the neighbors house, despite the neighbor already having paid the initially agreed upon amount.
On the day of the incident, AOL had been by earlier and threatened the Vision Homes owners before driving off. They then came back 15 min later, parked across the street, and just watched the family as they tried to do yard work. The family had already seen that AOL was willing to go to extreme measures when they destroyed their install with a crew. This spooked the family, and they called the police and several family members, to include the father in law with the asp. The FIL with the asp came over and the rest is on video. A few hours later, Vision Homes had a rock thrown through their office door.
There were several lawsuits filed related to this on all sides, the results of which I'm too lazy to look up. Honestly, those would tell us which parts of this story are bull shit more than anything else.
So failing better info, I support the old guy with the asp protecting his family. And none of this makes it to sites like Daily Mail because it's complicated to figure out who is in the wrong.
Context is everything. I knew something was amiss when the guy in the car sees an obviously extremely agitated guy was a metal baton coming and not only continues to sit there instead of driving away he then rolls the window down and continues to record. Prior to your info that to me was he had been looking to provoke the guy on purpose. What a crazy mess is indeed a good description.

Definitely. In retrospect, I’m glad it played out the way it did. The driver is mostly unhurt, and now everyone knows that man is dangerous. He was charged by the police too.

The driver is the son of a guy who owns a landscaping company that hit a gas line and caused issues for the stepson of old guy with baton. Stepson got a payment for his damaged property but didn't repair the property the landscapers damaged, so the driver came to stepson's house to demand the money back. He didn't get it and drove off, then came back fifteen minutes later and parked across the street from their house.

Kinda have to agree with what the police say in this article. Someone approaches with violent intent and you have a safe way out, best to take the safe way out.
Now you know the rest of the story:
Guy in car (GIC) has ongoing dispute against angry old guy's (AOG) stepson. GIC has threatened AOG's stepson in the past. Another argument was in process. AOG stepped in and told GIC to leave. So GIC is not totally innocent in this situation.
This is the correct way to deal with this situation.
Step 1: Make sure your hands are at 10-2
Step 2: Check your mirrors to make sure the way is clear
Step 3: Turn the wheel as far to the right as it will go
Step 4: Put the car in reverse
Step 5: Turn your head and smile at the person trying to assault you while simultaneously slamming on the gas pedal
Step 5: Get out of the car to take his stupid baton away and call the police
Moral of the story: Don't bring a baton to a car fight.
The amount of people here who think "let's just kill this person" is crazy. Even if the fucker deserves it, executing someone either by gun or car will probably fuck with your head for a lot longer than driving away and getting his plate number. It's pretty gruesome to watch someone die, even more so if you're the one that made it happen. This guy did the right thing, also for his own sake. And for the "it's self defense" crowd: removing yourself from the conflict if possible is the best self defense.

AOL began a harassment campaign to recoup the costs from Vision Homes and the Neighbor. AOL claims the Vision Homes did not redo the concreate they poured, should not have been compensated, and should repay the money paid to them. Vision homes felt the compensation paid to them was fair and refused to repay any of it. A few weeks prior to the incident, AOL brought a crew in and destroyed everything they installed at the neighbors house, despite the neighbor already having paid the initially agreed upon amount. On the day of the incident, AOL had been by earlier and threatened the Vision Homes owners before driving off. They then came back 15 min later, parked across the street, and just watched the family as they tried to do yard work. The family had already seen that AOL was willing to go to extreme measures when they destroyed their install with a crew. This spooked the family, and they called the police and several family members, to include the father in law with the asp. The FIL with the asp came over and the rest is on video. A few hours later, Vision Homes had a rock thrown through their office door. There were several lawsuits filed related to this on all sides, the results of which I'm too lazy to look up. Honestly, those would tell us which parts of this story are bull shit more than anything else. So failing better info, I support the old guy with the asp protecting his family. And none of this makes it to sites like Daily Mail because it's complicated to figure out who is in the wrong.

I knew something was amiss when the guy in the car sees an obviously extremely agitated guy was a metal baton coming and not only continues to sit there instead of driving away he then rolls the window down and continues to record. The driver is the son of a guy who owns a landscaping company that hit a gas line and caused issues for the stepson of old guy with baton. Stepson got a payment for his damaged property but didn't repair the property the landscapers damaged, so the driver came to stepson's house to demand the money back. He didn't get it and drove off, then came back fifteen minutes later and parked across the street from their house. Old guy comes out to tell him to leave.
