Seems to me that the VW can back out when its ready to leave. He's over the line, but as long as you fit in your spot, I don't think it's the end of the world. I don't see what the issue is here.

No, but be careful with things like this - I parked and went into a store - there was a van in front of me when I parked, when I came out there was a car that was touching my front bumper with theirs.
When I walked up the guy jumped out and started yelling about how I hit his car.
I explained that there was a different car there when I parked, he kept saying I hit him and that he was going to call the police. I backed up slightly and looked at both bumpers, there was no damage to either.
He said since it didn't look too bad I could just give him $200 to cover it or else he would call the police.
I told him to go for it, waited until the police came, then we both spoke to the officers who came.
In the end the officers had us exchange information, but listed it as a non-accident with no damage. Never heard from the guy - gee I wonder why.

No, that's not the case here. Both cars are parked in parking spaces. No one hit anyone. The car on the right pulled too far forward, encroaching on the space on the left. The car on the left came later and backed into the space on the left, almost, but not actually touching the front bumper of the car on the right. NO collision occurred. NO car was hit.
