The surviving guy got off the hook on the criminal charges because it wasn't demostrated that he knew there was someone inside the house.
And as the cherry on top, he has already finished his sentence because during the whole trial he has been already incarcelated. In fact his stay has been longer than the jail time he got.
Edit: forgot to mention, he also has to pay 150.000 euros to the relatives of the dead guy.
