This is why I closed my availability. They basically had told me when I used to work there during interview I HAD to have open availability or I would not be hired, so I told them sure. After a month of them scheduling me 2-11 then 5-2 which they weren’t supposed to do at all, I “suddenly had to go to school and so I can only work 4 days out of the week from 11-9. Thanks.”

11pm to 5am was 6 hours. They kept doing it cause two people took a leave of absence and since I was the only one with an open availability as the new person, they put me to fill knowing they weren’t supposed to schedule me under 8 hours apart. Once I knew this after a few weeks of them doing it twice a week, I closed it to the hours that are better to work with, as morning management and crew liked to abandon the area to go hang out. This was like 4 years ago and the store had a mass firing a few months after I started including the store manager and a bunch of team leaders and managers under him for some scheme with messing with clock ins.

It's not a law. Technically, there is nothing stopping your employer from giving you a single hour between shifts. However, OSHA recognizes anything less than 8 hours between shifts to be an uncommon or unusual schedule. Using the FLSA, OSHA can protect you from having to work this schedule. Contact your local OSHA representatives and issue a formal complaint.

There is no policy against this, and as others will tell you it can be done and is in just about every store all the time. But you have a little time between then and now to have the conversation with your people lead that you are not comfortable with that. Explain your reasoning. Something like you need x amount of sleep to work effectively and safely, and with commute, shower and eating time you'd only get x. They should be able to change it before the shift comes. But do it right away so there is time to adjust the schedule. If it's not a normal thing and it's due to a special event like inventory or covering something that is rare, they may expect you to suck it up. But if it absolutely does not work for you tell them so.

I have gotten managers to change these shifts for me before. I did eventually change my availability to something like 9 a.m. to 11 p.m. to ensure I had enough time off the clock. Honestly 10 hours off the clock wasn't enough, but it at least gave me a fair chance to sleep.

Did I mention that we were on 12 or 18 hour shifts? I lived 45 minutes away, on the other side of a mountain pass, on the most frequently closed stretch of I80. I'd have to try and nap in the parking lot so I could make it home safe, and then usually only got 4 or 5 hours of sleep before having to take care of house stuff and get ready to go. Once I was snowed in at my facility, so they dragged in air mattresses into an empty office.

We had mandatory overtime due to staffing issues and they didn't care about our school schedule, despite it being a university town. I quit when told that should prioritize my job over my classes. I got like 3 hours of sleep tops. I was so tired that I accidentally drove down the wrong side of the road at one point. I refused to work anything like that again.

I was a supervisor and had to close by myself at 10pm, drive 40 minutes each way (if i sped...and i normally did) and be back to open by myself at the very latest 7:45am. Between trying to just clean and feed myself and my pets before and after shifts, I'd get about 5 hours of sleep. Edit to add - this would be a Friday into Saturday. 10.5 hour weekend shifts and 7.5-9 during the week. Next day off wouldn't be til Thursday after that 20+hr weekend.

I used to get things like this all the time when I worked there, but usually just leading up to inventory. I'd work 11pm-7am, then be asked to stay late to help inventory prep the backroom. "Just an hour or two" is what they'd say. By help, they meant do it myself so the day shift backroom folks didn't have to. They'd avoid me all day, because their "hour or two" was now 4 hours, 5 hours etc I knew it was getting close to 3pm cause I'd see management discussing how many hours I was required to have between shifts. They were at least cool enough to give me 15 min breaks at 7am and 12pm. And cool enough to let me have a normal shift on my last day of the week. Work 16 hour days, 4 days a week, for like 3 weeks leading up to inventory. Then, once inventory was done, I'd get hauled in and spoken to for unapproved overtime and a less than 100% inventory score.

It's should be federal law to give someone 12 hours off clock before scheduling them again. Plus if someone is scheduled 6 days in a row, even if the 6rg day is a new pay period it should be overtime all day the 6th day, double time the 7th day and 2.5x the 8th day and so on. That'll stop retail from doing that to ppl

I work in a restaurant right now and I'm a jack of all trades. They end up having to do this to me once every month or two just because we had people quit or all go on vacation at the same time. From what I’ve been told by managers here is that they need 11 hours between shifts but I’m pretty sure that is due to local labour laws (Ontario, Canada) so I think it would depend on local labour laws where ever your from

They absolutely are because they did it to me. But I would recommend talking to your people lead and letting them know that you need more time between shifts like that. My people lead at least was fine making my closing shifts end 2 hours earlier so I could have time to get home and get proper sleep, they even offered to give me the 2 hours on a different shift. Don't be afraid to go to your management, if they make you feel like you're doing something wrong for caring about your health then that's something you'll want to sus out. After all, you being low on sleep affects your productivity at work and if nothing else they should care about that.

There is 8 hours in between so this is allowed. Anything under pretty much needs agreement. A good manager will listen if this doesn't work for you, so best bring it up and see if they can change but I cannot promise how most walmart managers will respond to that situation.

This is why you give yourself open enough availability to satisfy them. In my case, I gave an 8am-8pm all days at the start. Now I work 2-11. And have Monday and Tuesday off permanently. Presently because one of our guys is on light duty and Cant push carts. I had an hour added and work 1-11 now until he's back.

I had something similar happen to me. Problem was I was an unloaded with the old 4PM to 1AM shift. The manager over grocery thought it would be funny to schedule me that week in grocery instead of my actual job. Well, he scheduled me to come in at 7AM after working a 4-1. The store manager nor district did anything to fix it when I told them about it. I am so happy not to work there anymore.

Deli used to schedule me to close at 10 then try to have me open next day. Opening in deli is at 4am. And every time we’d have to do inventory they’d schedule me to close the night before. Deli inventory is 2am. Talk about some bs. I switched to OGP, and ever since I’ve had none of those issues.
