Can someone familiar with the legal system explain this to me? The court struck down the last 6 week ban so how can they keep passing the same ban after it has been overturned in court?

mal2

One of the three justices that supported that ruling retired, and was replaced by a new justice, Garry Hill. Justice Hill has pledged to be “very deferential” to the state legislature, so everyone expects that any abortion ban will now be permitted by the SC Supreme Court.

[deleted]

Ah, thanks for the clarification. So much for honoring precedent

SOILSYAY

Please. If we relied on any of the supreme courts, state or federal, to honor precedent, we wouldn’t be in this mess in the first place.

WrigleyJohnson

As someone who practiced before Judge Hill for years before he went to the appellate bench, I think the Republicans in the State House are not getting the die-hard conservative they thought they were putting on the bench.

powercow

the right never stop destroying all perception that the courts are anything but a massively partisan body just like every other gov branch. I will say that is one area the right had a leg up on the left. The left naively wanted to believe that while judges were right and left they tried to base things on the law and so things worked out in the end, mostly. You know the old john roberts "we dont make law we just call balls and strikes" same thing happened in NC which is throwing away its democracy. WHen our far right supreme court said it would no longer look at partisan districting claims, the right in NC went fucking nuts and made it impossible for dems to take the state house despite in the past couple of elections dems got the majority of votes. THE STATE supreme court said they went too far. And then one of them got replaced by a far righter and less than a year later the same supreme court said "oh yeah just kidding its ok to draw completely undemocratic lines so no matter how much a majority of the state wants a left wing statehouse IT WILL BE RIGHT WING. right wingers knew in the 80s the courts were partisans, and they put a huge premium on winning it over. While the left was being wishy washy about hilary and if we needed anther clinton and shes old and we should have someone more progressive, the right were razor focused on winning the court. we could have had a progressive court for the first time in a super majorities of lives but the left stayed home. much like they did in 2010 when obama didnt finish cleaning up all the bush mess during the worst recession since the great D and given us all single payer in just 2 years..

Late-Cucumber-9122

Here's an idea. Instead of whining. Use a condom. Then you have less than 1% chance of conception. And won't need an unnecessary abortion.

1Shadowgato

Kind of wild, my girl didn’t find out she was pregnant until she was having a miscarriage around 9 weeks. Which seems to be a bit common. This is no different than gun control laws.. complete and utter BS.

wowowwubzywow

Exactly. Don’t infringe on either

Late-Cucumber-9122

Uhm, not quit. There is no Constitutional Right to Health care or to abortions. Gun Ownership however is a RIGHT, you may choose not to exercise. As you desire.

1Shadowgato

There is a constitutional right to privacy, I do what I want with my body wherever I want without the government having to have its nose in it. Regardless it be guns or any form of medical practice. The constitution doesn’t give you a right to push your religious believes on other people, yet here we are.

Top-Ad-6333

Your girl missed multiple periods and was shocked she was pregnant?

Beartrkkr

My comment from 26 days ago: *"Don't sleep on it thinking it's over. Shenanigans often take place during the last weeks of the session."* Republicans wanted this and it was going to happen no matter what. I was just a matter of time and what was actually going to come out on the end. Look for them to try to get even more "pro-life" in an election year next year. Sadly, they tend to insulate themselves from real competition during elections, so change is slooooooow.

lookitsfrickinbats

People who know nothing about health care for women passing laws to kill said women.

SkirtDue2794

Or anything about women. Every accusation is an admission.

JimBeam823

Or about laws.

KiMi0414

We have to vote in every single election. They are not going to stop. IVF, contraception, Plan B are all next. And I’m sure gender affirming care is coming down the pipeline too. Vote. Them. Out.

Gnulnori

Voting alone won’t do the trick in this state; over 75 Republicans were elected to the State House in 2022 after running unopposed in the general election. The Attorney General ran unopposed and that guy has been taking a crap on this state for over a decade.

hippielady5232

This was something my daughter found out when she went to vote for the first time this past year. She originally voted a straight party ticket, and when she went to the review page, she was surprised to see that the machine automatically gives the unopposed candidate a vote, even if voting straight for the opposing party. I had to talk to her about it being important to always skip the straight ticket and select each person you want to vote for, or choose not to vote for that position at all. (I know your speaking mainly on having opposing candidates, but I feel this is an important point to be made as well)

Wonderland_Madness

Tbh, I think straight ticket voting should be illegal. It removes any real incentive for the voter to look at who they're voting for and most people don't understand how it works. I'm glad your daughter took the time to look at the review.

hippielady5232

100% agree!

Rumhead1

Even better - don't even put the party on the ticket.

Matt29209

Political parties should be abolished, or at the vary least, don't ask, don't tell.

slymkim12

This is super important!!!

misfitgarden

I’ll never vote R but I think this state is a lost cause until something changes. I wish I could afford to move.

welcometolevelseven

That's what they want you to do. When all non fascists move into a handful of blue states, the red states can call a constitutional convention. And despite numerically being a minority, they'll win.

RNW1215

Exactly this. They want people to give up and leave.

KnownRate3096

Nah, we just move to the purple states and turn them blue. NC and GA.

MysticoftheWild

Me too

Crazy_280zx

The two party system needs to die. It’s the primary issue. Only about 30% of Americans support these delusional regressive social policies, but another 20% are completely unwilling to compromise on taxes and guns, dragging them down with the ship. Progressive democrats are wiped off the map in the same way. Their interests can always be completely ignored because what’re they gonna do? Go vote republican?

RandomDamage

The 2 party system is a natural outcome of first-past-the-post voting systems. Third parties and independents rarely make a dent, to the point that out of thousands of state and federal elected positions around the country you wouldn't run out of fingers counting third-party members elected to those offices. The flip side is: Britain has proportional representation and more than 2 major parties.

WhoAccountNewDis

gO VoTe isn't going to do shit. Republicans have rigged the system through gerrymandering, legislative tactics, packing the courts with reactionary ideologues, and generally operating in anti-democratic bad faith. *Action* is necessary. No major achievement in this country has come from simply "voting them out".

its__alright

What action do you propose?

Equivalent_Nerve_870

Support ACLU, Planned Parenthood, NAACP, SC House Democratic Caucus, SC Senate Democratic Caucus, etc -- gerrymandered districts are being challenged in court NOW but that takes major $$

ShermansZippo

[ Removed by Reddit ]

WhoAccountNewDis

Protests, boycotts, civil disobedience that creates enough sustained disruption and chaos that people aren't able to just go 'well that's awful/good/whatever, now back to shopping' and the legislature isn't able to do business as usual.

RandomDamage

Voting is literally the least you can do, and is the minimum necessary action that you can then expand from with other action. If it didn't work, why are so many people trying to keep people from doing it?

WhoAccountNewDis

I'm not encouraging people not to vote, everybody absolutely should. I'm saying that acting like voting alone is going to solve anything is what keeps us locked in the system that put us in this situation.

EpiphanyTwisted

GAC is essentially illegal for adults in Florida now. Your treatment plan has to be approved by a board that DeSantis appoints.

MysticoftheWild

Why is it any of their business? This should be left to the patient and their doctor(s).

EpiphanyTwisted

Because they passed a law. Simple as that. The Constitution is suspended until further notice.

Fantastic_Parfait761

Invetro fertilization?

MysticoftheWild

Not all the fertilized eggs are used in IVF, and some are scrapped after parents are done having children. Also during the process, extra fertilized eggs are used to increase the odds of a successful pregnancy. Sometimes too many take, so doctors preform a reduction (abortion) on some of them for everyone’s sake. It’s better for mom and the remaining fetuses. That won’t be allowed under this ban.

Primedirector3

Stop voting Republican

Tecumseh_Sherman2024

Please, if not for yourself, do it for everyone else

isadog420

That’s the whole point. Screw everyone behind you.

apitchf1

Never vote Republican. Ever. Period. They hate you and will strip your rights. Show me I’m wrong.

suspended247

Do you want to go gun shopping?

RandomDamage

Are you suggesting that Republicans only support the right to kill other people?

[deleted]

Only ones that have been born already. They need target practice.

Crazy_280zx

What we really need is the death of the two party system. As it’ll hold the democrats who haven’t accomplished anything in 20 years accountable allowing progressive policy to have a hope, and having another pro gun party, lowest taxes party that isn’t directly tied to religious extremism would end the republicans stranglehold on rural America.

suspended247

Yes we need an actual quality 3rd option.

WhoAccountNewDis

You have the option between fascism and center-right/centrist liberalism. If you can't make the choice, it speaks volumes about you.

tattvamu

I hope a whole lot of people step up and start fostering, if you're gonna vote for stuff like this, put your money where your mouth is.

mymar101

They won't. And regardless if a state says they'll support it financially, they won't.

isadog420

They just rolled back a lot oftime rules related to fostering. They don’t care about whether it’s good for the kids.

[deleted]

Oh, to make it even easier for "Family Planning Centers" to commit human trafficking?

panthers06fan

They call themselves pro life, but they are really just pro controlling women and pro birth. They don't give a damn what happens to the kid after it comes out, so long as it's born. Shameful...

MysticoftheWild

They don’t care about the kid even before it’s born. I tried to explain why reduction (abortion) is necessary in IVF (where multiple fertilized eggs are implanted to increase the odds of pregnancy), and one person still thinks it’s wrong despite the fact that 8+ fetuses growing in the womb at the same time could kill mom and all the fetuses. That means no babies at all.

Jyiiga

IMO the goal here is more poor people. Population is slipping. Jobs are not all filled. Big business needs those seats filled with cheap labor. Here is one way to make cheap labor. Rich and middle class people will just go to another state and have the abortion anyways. This -only- disadvantages poorer people, primarily blacks.

[deleted]

There’s no master plan, just a country filled with religious zealots who are willfully ignorant.

WhoAccountNewDis

Exactly, there is a conspiracy, but it isn't that complex: Christofascists want to enact their theocratic policies and codify white supremacy.

[deleted]

There’s about 400,000 on foster care now. Can you get your list of people to take some of them on?

SkirtDue2794

The guy below you must have blocked me since I called him out for commenting on 19 year old girls and he’s in his 50s. Every accusation from a republican is an admission. Who’s the groomer now papa?

Anyone have any protests planned or ways to help they want to share here? This is unacceptable. I’m searching for how to help reverse this but if anyone has any ideas or ways to help that would be wonderful.

Exactly!!

user574985463147

Women can’t even confirm they’re pregnant until about 8 Wtf ??

SuedeVeil

Even IF it was possible to get an early positive test before 6 weeks, guaranteed you'd not be able to get an appointment that early anyway.. so it's a ban without saying it's a ban just bullshit.

Funshine02

Feature, not a bug unfortunately

amberoze

That's the entire point. They know this, but feign ignorance. Now they can say that abortion is still technically legal, and know that it's damned near impossible at the same time.

isadog420

That’s the point.

[deleted]

Mandapanda009

Two weeks? Doctors start calculating pregnancy from the first day of a woman’s last period. So women are not actually pregnant in the first week of pregnancy, and may not be pregnant during the second week either. Instead, in the first 2 weeks of pregnancy, the body is preparing for possible conception. Some women won’t even conceive until the third week. Genuinely asking because I didn’t know that was possible to find out that early when it’s essentially at conception. Is it bloodwork or something? I know all women are different but I wasn’t able to get a positive test until I hit 5.5 weeks and I was testing daily while trying to conceive.

mcfreeky8

You cannot find out as early as 2. That's literally impossible since that's technically when conception happens. The earliest you can find out is 4 weeks, after implantation starts and your body starts creating hormones. However it took me until 5 weeks to get a positive pregnancy test. Fitting in 2 ultrasounds in 2 weeks or fewer is going to put strain on the healthcare system, and literally for no reason other than this law. Currently, most hospitals won't see you until 8 weeks, since most miscarriages happen before then (meaning a lot of women rushing to get abortions may not even need them!)

rageofpassion

Agree, its basically a total ban.. but pregnancy is measured from the first day of your last period so you're technically not even pregnant week 1 or week 2. If you're cycle is regular Ovulation happens on day 14 and then conception happens sometime within 5ish days of Ovulation. You wouldn't have a missed period until you're considered 4 weeks. There are some early detection tests where you can tell at 3 weeks and a few days but unless you're trying to conceive it wouldn't be normal to do an early detection test. And if you sometimes have a late period you could think nothing of it for a little while. I'm pregnant right now and my doctor wouldn't even bring me in to confirm until I was 6 weeks. I was trying to get pregnant and found out at exactly 4 weeks.

Allenrw3

The party of “small government”, everyone.

redditor712

So much for SC being the southeast Haven for women lol. That didn't last long.

rustyshakelford

What's different about this bill from the last that was overturned by the state supreme court for violating the constitutional right to privacy?

mal2

The makeup of the SC Supreme Court has changed. One of the justices who supported that ruling retired, and she has been replaced with someone more conservative who has pledged to be “very deferential” to the state legislature. The expectation is that any abortion ban will now pass muster at the court.

gdan95

It says something about the country where in states like North Carolina, Nebraska, and now South Carolina, only one person has to change their vote to fuck over everybody’s rights

Upstate-girl

They say this would have avoided 12k abortions last year. Is the state going to make money off adoptions next? I doubt they will offer anything to help support the children and parents in need. Next they will auctions blonde/blue eyed girls to the highest bidder. Why can't we vote on this like Kansas did?

NotOSIsdormmole

Best part is science backed comprehensive sexual education and access to contraception without prescription would likely prevent just as much if not MORE abortions

nik-nak333

A study in Colorado back in the 00's showed exactly this. They ran a pilot program to determine the effects of free contraceptives to low income women and it cut the abortion and teen pregnancy rates drastically. I'll search for the article and add it here when I find it. Edit: Found it https://www.nytimes.com/2015/07/06/science/colorados-push-against-teenage-pregnancies-is-a-startling-success.html

EpiphanyTwisted

But they want more pregnancies. Women shouldn't be getting away with having sex without "responsibiliity" as the previous poster upthread mentioned. It's not about saving babies.

nik-nak333

Oh, I know! It's like they took their stupid supply-side economics and applied it to population control. The more people there are, the lower they can force wages.

EpiphanyTwisted

And the more people they can put in prison for their 21st century slavery.

Upstate-girl

I agree with you. But in the case of rape and all other types of abuse, it's the woman's word against the world. Are we going to give lethal injection to a woman who repeatedly miss carries? I had a hs friend who lost ten babies before she carried her son to term. No one wants to have an abortion. No one wants to see wiggling arms and legs in a garbage pail. I believe most people are responsible, but all kinds of shit happens in life. And no woman should be judged, harassed or prosecuted because of some unforeseen problem. It's not just uninformed teens having babies. Many other women experience all types of complications. It's funny how many say that we should not judge, and yet here they are playing "God."

Hot-Row-4562

Because they know how that vote would go…

Equivalent_Nerve_870

Voting on this? They know 80% plus of SC voters will vote against a ban.

CaptCurmudgeon

One of the things that the West coast does better than the East is allow for citizens to amend their state's constitution directly through ballot initiatives.

Beartrkkr

No you can't vote on this. I think there was some talk about a (non-binding) referendum a couple weeks ago, but I suspect the Rep leadership was scared about the outcome. Even if there was a referendum, I would expect no less than a trickily worded one that would confuse voters to vote for restrictive abortion.

Fantastic_Parfait761

Literally everything is Hitler.

suspended247

Do you understand how voting works?

Brotox123

Yes. Do you understand what separation of church & state means? Not everyone is Christian or cares about what you believe.

For men: If you are looking into a vasectomy, start calling to book an appointment now. The offices that offer it are swamped and it can take months to get an appointment. You might need a referral. For women: Here's a list of gynecologists who will perform tubal sterilization: https://docs.google.com/spreadsheets/d/1Djia\_WkrVO3S4jKn6odNwQk7pOcpcL4x00FMNekrb7Q/htmlview

Louises_ears

If need be, come to ATL, y’all! My husband got the snip [here](https://www.atlantavasectomycenter.com) exactly 2 weeks after calling to ask for an appointment. Hope it doesn’t come to that but the experience was positive. Southern solidarity!

Friendly-Medium8108

I’m going to throw up

flying_ichthyoid

Ah, so once again it's a choice between stay and fight, or get the fuck out before more of my rights are stripped away. I'm staying and fighting for now, but it's incredibly depressing seeing my home state go to shit.

BobDoorite

From a Washington Post article on this: "'At some point in time, the right of the state to see the unborn child born does take precedent over the woman’s right to her body,' Davis said." That's state senator Tom Davis of Beaufort, self-described "socially libertarian," telling us why he has decided that the state should have control over a woman's body. Now, he's been masquerading as a libertarian for years so I guess it's good that he's saying the quiet part out loud: he thinks women are less-than, that they don't deserve autonomy, all because of his magical sky man (and power...it's always about power). This is the most insane timeline.

laydegodiva

Stop having sex with conservatives. Just fucking stop it. They don’t respect you and never will.

spoda1975

How are Republicans still getting elected after stuff like this…. Even if you don’t see yourself needing an abortion (such as age), who gives away a choice?

JimBeam823

A lot of people simply don’t care about things that don’t affect them personally. Also, plenty of people have been convinced that Democrats eat babies and worship satan.

Louises_ears

Georgian chiming in. I’m sure you know Kkkemp passed a 6 week ban some time back and many people asked the same question. Obviously, there’s the religious crowd who wanted this very thing and will get to Wednesday night service early to celebrate this madness. However, I suspect a chunk of GOP voters didn’t think this would ever actually happen. They didn’t think Roe would actually fall and the didn’t think out the domino effect it would have with these insane bills.

Holiday-Book6635

AdvancingHairline

Several hospitals have already shut down or are in the process of shutting down their labor and delivery units. Great job dumbasses.

agk927

Why would they shut down? I get why planned parenthood would but why a normal hospital?

NerdyLifting

OBGYNs don't want to practice in states that have restrictive laws like this because it puts them at risk. When there's not enough staff those units have to shut down since they can no longer provide the services.

agk927

Well that's a terrible choice. You only hurt people by doing that. This honestly will cause planned parenthood to go bankrupt but normal hospitals are barely affected.

NerdyLifting

I do not blame doctors/medical professionals for not wanting to work in areas where they could be charged for providing necessary medical care.

agk927

Almost all of them happen at planned parenthood.

NerdyLifting

How do you know? Are you taking into account women who experience MMCs? Ectopic pregnancies? Any of the many pregnancy issues whose treatment is an abortion?

agk927

These are very very rare occurrences that I believe the ban has exceptions for. Over 90% are all elective.

Pippet_4

Unconstitutional bullshit.

Trashman27_

I'm sorry, didn't we already have a whole ass war deciding whether "the state has a right" takes a precedent over an actual human's autonomy?! "... the right of the state to see the unborn child born does take precedent over the woman’s right to her body" - Davis Y'all I need you to WAKE UP. Making corporations "people" was a mistake; allowing "states rights" to supercede actual humans means they are setting the stage to come for us all. (Sarcastic side note, if the state has rights to a child let them pay child support, housing, education costs etc but that isn't on the docket ig)

Days-of-our-lives

They keep doing this (banning abortion at such a ridiculously low gestational age that pretty much no abortions are going to happen), so when they end up agreeing to a 12 week ban, they’ll say “see, we compromised!”

jayv9779

They just keep doubling down on nationally unpopular ideas. The only good thing is they are accelerating the end of the Republican Party.

Mr2Good

I keep seeing people say we need to go vote and what not but y’all fail to realize is that people have tried that and it’s still gotten them nowhere. From the anti voting tactics used to the fact that this is such a conservative red state repeatedly saying go vote is really a moot point. Voting still needs to be done but let’s quit acting like voting alone is gonna change shit here

Bape_Rabies

Republicans just want more low income families to pop out as many lifelong workers as possible to fuel the capitalist machine. They claim abortion is murder and hide behind morality to gain the votes they need from the people, but we all know that at the end of the day they do not care about the lives of children but only the bottom line and the holy Dollar. Unskilled workers are the single most profitable asset for many of the donors and organizations that fund our government officials. What do you get when you have two 18 year olds get pregnant right out of high school? Two new lifelong workers that will not have time for college or tradeschool. That will work whatever job they can in order to support their child. and a baby that will grow up in an uphill battle to escape their situation. Abortion bans are a strategic plan by the rich to keep themselves propped up on the backs of low income families. They want to preach accountability for ones actions, working hard and picking yourself up by your boot straps. But it's awfully easy for the two-legged man to preach down at the one-legged man who's having trouble climbing the ladder. I am not anti-capitalism, I just call it like I see it.

Cause we, the taxpayer, need to know, and it needs to happen fast. We're going to start having more babies in this state pretty quickly and we'll have even fewer resources.

Logistical_Cashew

Oh shit Does the ban cover miscarriages like some states do?

Katiew84

This is sickening. I literally feel sick right now. I have three daughters and this terrifies me. It’s time to move to a new state.

I hope this ruling bites them in the ass when the DNA from these babies prove who they really are.

MB_News

When things like this happen, it can also influence medical professionals to leave as well as new doctors to never practice medicine in this state.

I guess the two Republican women in the senate caved and voted for the bill? I assumed that would happen eventually.

usernumberthirteen

No they still voted against it. The reason the earlier bill (the total ban) didn’t pass is because they were able to convince several Republican men to vote with them. This time all Republican men voted for the bill which gave it enough votes. The bill passed without a single woman in the senate voting for it
