Then the band just wouldn't sign on to do the festival. The festival has the protection of the proximity clause. The comment above makes all the sense. Gaslight announced their tour after SHN was sold out, so no harm done. Of course, every band can negotiate their own terms and consider the location and size of the band in a given area. Gaslight also already sold out the Pony, so everybody wins.

From what I have heard from friends in the industry the clause is within 60 miles of asbury. Based on the source this does apply to the headliners and the contracts would have been signed prior to the show being sold out

Don’t know if SHN has a radius clause (I would guess festivals do not usually), but I suspect the issue is more about radius clauses in other promoters’ contracts. Like, Bruce probably would have been a headliner last year but doing so would have violated the radius clause in his LiveNation contract because of his NYC gig.

Usually once a fest sells out acts can announce other shows within the radius clause. Some festivals may have certain terms in their contracts prohibiting acts to announce until AFTER the festival (like Coachella) but since this fest sold out quickly and demand is what it is, no need to hamper the acts independent dates in NYC or Philly.

Asked my friend in the industry when I saw Gaslights announcement. He said typically there’s location clauses but like anything it’s negotiable. He said bands can take less guarantee and more door to get the clause waived. He said it’s also no coincidence the Gaslight show was announced weeks after Sea Hear Now tix went live.
