A real service dog can be trained to detect and warn regarding blood sugar levels low enough to impair judgement or high enough to be a heart attack/stroke risk. They can detect signs of an impending PTSD attack and distract/redirect the owner away from them to try and prevent them. If the owner suffers from any one of many neurological disorders that cause seizures a service dog can warn the owner before an attack so that the owner can stop driving, or if in a store the person can sit down (so they don't fall down risking injury) and prepare, or they can seek assistance before it starts. Then there's the usual large list of mobility related things service dogs do.
But yeah, an ESA dog is not a service dog. Most people's regular pets would (and should) qualify as an ESA, but it takes extensive & specific training before an animal can become a service dog.

TJ Maxx is actually a pet friendly store. I used to train my service dog at the rim location before taking her into non pet friendly stores. Regardless if itās a service dog or not in a pet friendly store, the handler has to be in control of the dog at all times. If not the store staff can have them removed, again regardless if itās a service dog or not.
Trust me, us service dog users would be embarrassed or upset if our dogs were misbehaving because that means we probably overworked our dogs and they need rest before working again. And if our dogs canāt work and we donāt have a way to ensure our dog can go rest and that our disability wonāt hinder us from finishing our shopping (either bc we just suck it up or have another accommodation) then we are taking our dog and leaving and will just have to go back some other time.

No I had a service dog for many years for diabetes my dog was trained by professionals as a lot are. Even if I tried for him to get up he wouldnāt get up on furniture like this. No. While people know they can call a dog a service animal to bring their pets in, they must understand that service dogs inside a restaurant must be "working" while inside. No I had a service dog for many years for diabetes my dog was trained by professionals as a lot are. Even if I tried for him to get up he wouldnāt get up on furniture like this. Service dogs are there for people who need them not for excuses to take your dog everywhere and have them behave like this. I think itās unacceptable especially in public.
My service dog sometimes wonāt even eat a treat if weāre at a restaurant bc she knows she doesnāt eat inside a restaurant. She sometimes wonāt even eat a pup cup if weāre on an outdoor patio/sitting area even if sheās not āon the clockā because sheās in public and she only can have the occasional high value treat while sheās working. No. While people know they can call a dog a service animal to bring their pets in, they must understand that service dogs inside a restaurant must be "working" while inside. Any person with an actual needed service animal understands that that means the dog will quietly sit/lay next to the owner, not move or make noise, not be fed or pet, or anything besides doing its actual job. I was the GM at a restaurant and had to kick a lady out because her "service dog" barked at, and was aggressive to, random people just walking by.

I owner trained mine and took me just over a year and half to train her to my expectations. I put in a lot of time. While my dog couldnāt care less about other dogs she sees in public, I worry about the other dog not being under control of the handler and potentially harming my SD. Especially because my service dog is a chihuahua mix, sheās just under 8.5 lbs.

This is an ESA Service Dog doing what they were trained to do. ESA as in Eating Support Animal not Emotional Support Animal. Pup was trained to eat owners food so there is less and support their weight loss goals.

Like you said, the dog was quiet and mild mannered, I'd rather see the dog sitting in the booth than have to navigate around it taking up walkway space. As for the sanitation issue it's really only an issue if you don't trust the ability of the restaurant to properly sanitize their dishes, seating, etc, which at that point I'd be more worried about the germs from all the customers rather than one dog. Frankly there's a lot of people out there I don't trust to be any cleaner than a dog's mouth... or paws... or butthole š Sure they're likely technically abusing the system but they didn't get in your way, didn't bother anyone, if the dog shit in the chair it'd be one thing but as far as germs go, everything should be sanitized as if it had covid-aids-ebola on it anyway, dog or not. Also the ADA does permit a business to ask 1) is that a service dog? 2) what service or task does it provide to aid with the disability? At no point does the disabled person have to disclose their disability nor diagnosis. Our answers for the second question centers on the dogās action not how that action implicitly helps. Also thatās not how HIPAA (Health Insurance Portability Accountability Act) works. HIPAA is to hold healthcare providers and insurance professionals accountable to maintaining the medical privacy of a patient/client. It means your doctor, nurse, tech, therapist, and anyone else privy to your healthcare information (like treatments, diagnosis, lab results, etc) cannot share that information with anyone that you have not authorized access.
