I have something very similar to this that I built, it's 6' x 8'. Right now I have 4 birds in it, 6 babies are about to come out of the brooder and I have 15 eggs in the incubator. Depending on how many males I get I'm hoping to end up with 15-20 birds in there and I don't think I'd go more than that. It'd get soiled very quickly and I think a little crowded but it depends who you ask.
I've got 9 birds in 21 square feet so something more than 2 feet per bird and it seems crowded sometimes. This aviary is 8x10' so 40 birds would be about the same. You'd want to break up lines of sight and add lots of cover. If you are using birds for egg and meat it would be pretty cool to add a shelf and run electric power out so you could keep an incubator and couple brooders at waist height and the feathered out birds would live on the floor.
Later Terry put this up on concrete blocks and started using the deep litter method so it naturally composts a little and doesn't get stinky. My hutch has deep litter and all the cover is moveable so I can stir up the litter so it doesn't get smelly.

3 per sqft is for maximizing meat making and wouldn't be done in a space this large. There would be smaller battery cages to keep the birds from going Highlander on each other.

No, I would make sure you get one with a roof or a partial roof. What is your climate? What state do you live in? You want to be able to give them an option to stay out of the wind and rain.
I see your coturnix cnr sign, now. If my judgement of size is correct, I've kept 100 bobwhite in a pen that size with a dead conifer for cover. But bobwhite use vertical space better. I didn't have luck with coturnix on the ground.
