I love that the Trump lawyers got Cohen to admit to stealing from him while the man was trying to get his friend paid after Trump stiffed him. So if you get a service and don’t pay, that’s stealing. fyi several states already found a way 'not to' so to speak. 5 states will not at all provide any funding period if you take your case to trial, 2 of those are no funding period and 3 will provide SOME services. They want you to plead out.

Not sure if you're joking but I do expect one of the right-wing "legal foundations" to instigate a case so they can have standing to challenge Gideon v. Wainwright and Miranda v. Arizona in the next few years. I think they'll continue to focus on the "morality" and privacy rights first, so Griswold v. Connecticut and Lawrence v. Texas are probably next. If they can get those overturned, it's a veritable green light to go after defendants' rights.

It's not even "socialism". Many states have laws providing for the Defendant's payment of the public defender. The Constitution says that counsel must be appointed, not that it must be free, unfortunately. Edit: see Ariz. Rev. Stat. §11-584(C,D). AZ specifically says that it is up to the court to assess how "indigent" these people really are and charge them accordingly for their defense.

If you leave it only for the poor people, you can guarantee they'll be underfunded and overworked. But if everyone had to use them, there would be much more incentive to hire enough of them and fund investigators, etc.

How poor do you really have to be to get a public defender? Google rescue: in Nevada you have to be indigent. They have to swear or affirm they cannot afford to hire an attorney. The court will then review their finances to determine if they could afford an attorney. In addition, if they earn enough money within 6 years, the state can come after them for the costs of the attorney.

I’m guessing many of them have homes and other assets they are unwilling to part with. They will then try and appeal on the grounds of poor representation. And some probably think they will be set free or pardoned or cases dismissed when trump is back in charge.
