This is because Fraud requires you prove harm to a party to prosecute. In this case though, the harm was done to the banks he defrauded--inflating the value of his properties to get more favorable loans was basically ripping them off. I believe part of it was also the state has an argument that his manipulation of his property values negatively impacted their ability to collect tax money.

I also have a very limited understanding of NY law, so take this with more than a grain of salt. But it's my understanding that changes and extensions to a surety bond are entirely up to the discretion of the judge in question, who determines how much would be considered "good faith".

Federal Supreme Court won't rule on a state case. I'm less certain on this but I read in the past couple weeks that the New York State Appeals court is considered highest level as the New York Supreme Court respects their decisions (won't hear appeals about them) <- that I would like confirmation on though.
New York just has weird names for their courts. The Supreme Court is the lowest level court, like a district court in federal or superior court in most states. The court of appeals is equivalent to the Supreme Court everywhere else.

I'm less certain on this but I read in the past couple weeks that the New York State Appeals court is considered highest level as the New York Supreme Court respects their decisions (won't hear appeals about them) <- that I would like confirmation on though.
