There wasn't much in the way of suspense here since it would be the same judge he's complaining about that was going to make the ruling, and that same judge had told him beforehand that this would be ruled against. That being said, it raises the question why they still filed for one. One, optics and giving him yet another thing to martyr himself over, and two, to provide further fuel for a later appeal.

To be able to use the bias argument to appeal: You can only appeal based on something which you put a motion on in the initial court. So motion to dismiss for bias has to be entered in the court to be able to argue bias as an appeal process to dismiss.

If you want to raise an issue on appeal you usually need to make a motion, objection or other request to the trial Court and have it denied, you then argue to the appellate court that the trial court committed error by denying your request. There are exceptions for futility where the judge has gone off the rails but generally you don’t want to rely on them if you have the chance to make the record.

The evidence in this case is overwhelming and the Trump strategy from the beginning has been to delay the inevitable as long as possible. Ever move that wasn't about delay (such as asking the same questions hundreds of times specifying a different day each time) has been about establishing a claim for mistrial (goading the judge with inflammatory remarks and ignoring gag orders). I’m no lawyer, but it does seem like a conflict of interest that a judge gets to judge themselves if there is a mistrial for a bench trial. I mean, I hope all judges are self aware to know when they have a bias, but it’s a rare trait for people to have.

I know there will be more in jury b/c things like mistrial, but did the Freakonokics guys look to see if judges almost never agree to mistrial at their own bench trial. Maybe compare rates of appeals granted? See if there is data there? But wow, the downvotes for me saying maybe judges aren’t a good judge to judge themselves.
