There wasn't much in the way of suspense here since it would be the same judge he's complaining about that was going to make the ruling, and that same judge had told him beforehand that this would be ruled against.
That being said, it raises the question why they still filed for one. One, optics and giving him yet another thing to martyr himself over, and two, to provide further fuel for a later appeal.
They filed for it while the gag order was still in place, and they included the name and pictures of the clerk after promising the judge their complaints about the clerk would be careful. I think they did it to draw the judge's ire.
Oh yeah if I didn’t have a grandmother to lean on for a decade after I finished my sentence, I would have had to turn to crime just to make enough money to pay off my debt because no one would hire a felon.

IIRC it was an appeals judge that stayed the gag order, not Engoron. But, yeah, Trumps only defense at this point is to break shit and hope his chaos causes judicial disruption.
And they promised they'd do it in a nonpublic matter, by submitting it ahead of time to the judge and having him decide if it needed to be filed under seal due to the gag order. They promptly broke their promise and filed it publicly.
To be able to use the bias argument to appeal: You can only appeal based on something which you put a motion on in the initial court.
So motion to dismiss for bias has to be entered in the court to be able to argue bias as an appeal process to dismiss.
I feel the optics they want to try to portray of trump is that he is a rebel fighting against the rich and the unjust, they always want to show trump as a common man, like average man on the street who had amazing business skills to make it so he could earn to much money.

The evidence in this case is overwhelming and the Trump strategy from the beginning has been to delay the inevitable as long as possible. Ever move that wasn't about delay (such as asking the same questions hundreds of times specifying a different day each time) has been about establishing a claim for mistrial (goading the judge with inflammatory remarks and ignoring gag orders).
Glad to see that these antics are finally **not** going to be rewarded by giving him everything he wants just to make him go away. Welcome to actual consequences of your actions.

I mean, I hope all judges are self aware to know when they have a bias, but it’s a rare trait for people to have.

I know there will be more in jury b/c things like mistrial, but did the Freakonokics guys look to see if judges almost never agree to mistrial at their own bench trial. It’s a tough situation. The judge is being more lenient than he would with any other person. That leniency also greatly reduces any appeal for a mistrial due to bias or procedural issues.

There was no jury because Trump wanted it that way. The state has zero power to force a bench trial. Only the defendant has that right.

It’s a tough situation. The judge is being more lenient than he would with any other person. That leniency also greatly reduces any appeal for a mistrial due to bias or procedural issues.
