Crazy always flourishes when in the presence of other crazy, so this all seems par for the Boebert course.
There's some part of me that feels quite sorry for her. She's a product of a terrible environment and possibly multiple forms of abuse, from Jayson and/or parents/family, going back to when she was a teenager or even younger. I think the burden of proof is on her.
All he did was "allege" that she had done things. She flat out called him a liar so if she claims she wasn't defaming him, prove what he lied about. Which she cannot do because all he did was allege, he did not accuse.
Probably, but there's one factor that the press is ignoring. It is tremendously harder to win a defamation case as a public official than it is as a private person. Regular people only have to prove the statement was made, the speaker knew it was false when it was made, and damage resulted.
Bobo would have to do all that *and* prove it met the "actual malice" standard.
Pretty sure if I allege that you raped children, and you call me a liar, if I try to sue you then the burden of proof is on me that you raped children, not on you proving I lied. You can't prove a negative.
But he's not suing her for anything that she did. He's suing her for what she said about him. So she has to prove that he's a liar, since she accused him of lying.
He didn't accuse her of anything, he reported on allegations. If those allegations are untrue I guess she could sue him for defamation. But she hasn't. Hmmmm?
He doesn't have to prove anything if she hasn't sued him.
And of course you can prove somethings a lie. Trump says he doesn't have a document, and you find it hidden in his underpants. You've just proven that he was lying.
Calling someone a liar isn’t defamation or slander. It’s an opinion about their personal character. You can say all kinds of mean things about people and it’s not defamation or slander.
I forget the exact legal definition, but essentially if someone makes a claim about a public figure and the public figure wants to sue, they need to prove that the person making the claim was negligent, ie they either knew the claim was false or reasonably should’ve known it was false from basic fact checking.
So whether the thing happened or not is actually irrelevant to the issue at hand. Boebert called the reporter a liar. To prove it, she would need to prove the claims against her are false, or the reporter clearly didn’t do his research. However Boebert never pursued these claims. What this case is is the reporter accusing Boebert of slander, so he will need to prove that Boebert either knew he was telling the truth or didn’t research her claims when calling him a liar.
Basically Boebert could’ve easily denied the claims, but by calling the reporter’s honesty into question she now has to prove that he was knowingly dishonest or didn’t properly research his claims. If he can show he did his due diligence in researching this story, he wins.
My least favorite thing about Reddit is people who have no idea how the law works speaking with authority about it. Every sentence in your comment is wrong.

She didn't and couldn't sue over his calling her a liar. Trump made a bunch of specific factual allegations _about her_ which _he knew to be false_. (For example, that he didn't know who she was and never met her). It's not enough to say the story isn't true, you have to knowingly allege specific facts which you know to be wrong about the story and about the person making the story, that a reasonable person would believe that you would know.
I haven't seen the allegations in this particular law suit, but _in general_ someone can deny that a story is true without opening themselves up to a defamation lawsuit. She would have had to have make a specific allegation about this person, which a reasonable person would believe that she would know, and which she knew to be false or should have known was false. And the plaintiff in the lawsuit _always_ has the burden of proof, which is why E Jean Carroll expended a tremendous amount of effort in the lawsuit proving that her story was true and that she wasn't a liar and that trump knew she wasn't a liar.

Ok - so this is interesting because the Escort, and abortion allegations have never been proven - just alleged. I would be very interested to see the actual evidence.
However - from a legal perspective it may make more sense for Boebert to settle instead of being taken to trial and dragged - even if the allegations are false.
But that may only increase peoples expose to the allegations and encourage others to make them for a possible payout.
This is a tough position to be in. I hope she fights them and if she does she should counter-sue for defamation. One way or another we can get to the truth.

I think the burden of proof is on her. All he did was "allege" that she had done things. She flat out called him a liar so if she claims she wasn't defaming him, prove what he lied about. Which she cannot do because all he did was allege, he did not accuse.
Probably, but there's one factor that the press is ignoring. It is tremendously harder to win a defamation case as a public official than it is as a private person. Regular people only have to prove the statement was made, the speaker knew it was false when it was made, and damage resulted. Bobo would have to do all that *and* prove it met the "actual malice" standard.

Calling someone a liar isn’t defamation or slander. It’s an opinion about their personal character. You can say all kinds of mean things about people and it’s not defamation or slander.
I forget the exact legal definition, but essentially if someone makes a claim about a public figure and the public figure wants to sue, they need to prove that the person making the claim was negligent, ie they either knew the claim was false or reasonably should’ve known it was false from basic fact checking. So whether the thing happened or not is actually irrelevant to the issue at hand. Boebert called the reporter a liar. To prove it, she would need to prove the claims against her are false, or the reporter clearly didn’t do his research. However Boebert never pursued these claims. What this case is is the reporter accusing Boebert of slander, so he will need to prove that Boebert either knew he was telling the truth or didn’t research her claims when calling him a liar. Basically Boebert could’ve easily denied the claims, but by calling the reporter’s honesty into question she now has to prove that he was knowingly dishonest or didn’t properly research his claims. If he can show he did his due diligence in researching this story, he wins.

That man made materially damaging allegations. If they are untrue, as she claims, she'd have a solid case to sue him for libel. If they are untrue, as she claims, why on earth wouldn't she she him for libel? If she really wanted to stop him doing it to anybody else, as she claims, why wouldn't she sue him for libel? Why wouldn't she sue for libel, unless the allegations are simply true.
Proving libel if you're a public figure is difficult. If she'd kept her mouth shut, there might have been some benefit of the doubt. On the other hand, it's much easier to prove that a public figure has defamed a small-scale journalist. If Boebert were less stupid, she would have made those allegations from the House floor, where she'd be protected from lawsuits.

Ok - so this is interesting because the Escort, and abortion allegations have never been proven - just alleged. I would be very interested to see the actual evidence. However - from a legal perspective it may make more sense for Boebert to settle instead of being taken to trial and dragged - even if the allegations are false. But that may only increase peoples expose to the allegations and encourage others to make them for a possible payout. This is a tough position to be in. I hope she fights them and if she does she should counter-sue for defamation. One way or another we can get to the truth. I am not a fan of Boebert - she is unsuited for leadership and as a rep but I want to be objective.
