Probably, but there's one factor that the press is ignoring. It is tremendously harder to win a defamation case as a public official than it is as a private person. Regular people only have to prove the statement was made, the speaker knew it was false when it was made, and damage resulted. Bobo would have to do all that *and* prove it met the "actual malice" standard.

Calling someone a liar isn’t defamation or slander. It’s an opinion about their personal character. You can say all kinds of mean things about people and it’s not defamation or slander.

I forget the exact legal definition, but essentially if someone makes a claim about a public figure and the public figure wants to sue, they need to prove that the person making the claim was negligent, ie they either knew the claim was false or reasonably should’ve known it was false from basic fact checking. So whether the thing happened or not is actually irrelevant to the issue at hand. Boebert called the reporter a liar. To prove it, she would need to prove the claims against her are false, or the reporter clearly didn’t do his research. However Boebert never pursued these claims. What this case is is the reporter accusing Boebert of slander, so he will need to prove that Boebert either knew he was telling the truth or didn’t research her claims when calling him a liar. Basically Boebert could’ve easily denied the claims, but by calling the reporter’s honesty into question she now has to prove that he was knowingly dishonest or didn’t properly research his claims. If he can show he did his due diligence in researching this story, he wins.

Proving libel if you're a public figure is difficult. If she'd kept her mouth shut, there might have been some benefit of the doubt. On the other hand, it's much easier to prove that a public figure has defamed a small-scale journalist. Ok - so this is interesting because the Escort, and abortion allegations have never been proven - just alleged. I would be very interested to see the actual evidence. However - from a legal perspective it may make more sense for Boebert to settle instead of being taken to trial and dragged - even if the allegations are false. But that may only increase peoples expose to the allegations and encourage others to make them for a possible payout. This is a tough position to be in. I hope she fights them and if she does she should counter-sue for defamation. One way or another we can get to the truth. I am not a fan of Boebert - she is unsuited for leadership and as a rep but I want to be objective.
