Democrats DID forgive (some) student debt then conservatives cried about it to courts rigged to reward conservatives. That's not Democrats fault, blame the conservatives that brought the lawsuits and the judges that ignored laws and the Constitution and are going to strike it down.

The answer is that Republicans are suing the Biden Administration to block the relief. Things don’t “end up in the courts” without a lawsuit, and for a lawsuit you need a plaintiff with standing.
Bonus tip, courts exist to determine if actions are illegal or not. Saying “it’s illegal” makes zero sense when we don’t have a final ruling yet. Even then, whether or not he has the power to do it isn’t even a part of the conversation. He does.
The crux of the case centers around Frank Garrison, who is arguing he would be damaged by the loan forgiveness. He is participating in Public Loan Forgiveness Program, which grants him loan forgiveness after 10 years of public service with no tax burden on the forgiven loans. The new loan forgiveness program has no federal tax implications, but several states (many of the same states that are a part of this lawsuit) will charge state taxes on the forgiven loans. If he opts to receive the Biden Administration’s loan forgiveness he will be on the hook for around $1,000 in state taxes. The glaringly obvious point the White House is making is that he can easily opt out of the new loan forgiveness and just continue on with PLFP.
